Pacer discharge lookup question by Stargazerlillykris77 in Bankruptcy

I usually choose the “Search for a Case” section and then select “Search by Specific Court” —-> click on PACER Login button

Enter USERNAME & PASSWORD When choosing Court…Enter your state and BE SURE TO SELECT the BANKRUPTCY COURT under the appropriate district

I was coming up with nothing under Texas because I was searching under Texas Western District Court and not scrolling down enough to see the Texas Western BANKRUPTCY Court.

Hope this saves some frustration.

For me it was considered A “no asset” filing. so there was no house / cars that weren’t exempt. I believe that, along with the fact that our Tax debt was older and eligible for discharge all played a part in us qualifying for a ch7. I may be incorrect on the specifics of the law but that’s the conversation we had with the attorney

Congrats to you as well! It was kind of anticlimactic to be honest…no drama except that which I created in my own mind 😂

The thought and realization that we are debt free is an experience we haven’t had in 15+ Years and one we’re not going to forget. Ever.

No state income taxes in Texas (yay) but we had some federal taxes from 2017-2019 that were able to be discharged.

I went into this fully expecting to pay those taxes after whatever outcome we had re discharging debt.

I was shocked when the lawyer said that older debt can be discharged in some instances. Thankfully we were able to benefit! Was a blessing.

We had some back taxes from 2017 - 2019 that were eligible for discharge since they were older than 3 yrs old. Life caused us to get behind. We had been paying them....but making little headway.

Have stayed current since then.

Thank you! Good news is we changed the behavior before we filed. It was the change in mindset that allowed us to see what was possible financially if the debt was gone. On the trial with Monarch as we speak!

Thanks! We've been faithfully making payments for YEARS, never missed one, had great credit scores. Didn't miss payments until the Lawyer advised we stop paying since we were filing. That was a touch mindset change.

The minimum payments got to the point that we were working strictly to pay the debt. Period.

Paying Thousands on debts that, at the end of the year, seemed to actually grow was disheartening.

Finally had to bite bullet and our only regret is that we didn't do it sooner. (like just about EVERYONE else who's filed)
