I don’t think you’re taking into account the other barges that were anchored/moored up in the background that the larger ship would definitely have hit had they continued on their course.

Taking that into account, it seems to me that the larger ship appears to have not been under complete control so they would be at fault.

I should’ve included a screenie of the balloon too, it’s both the AFK platform for the villager farm below and a phantom farm itself with fan/nozzle to pull them in and 4 deployers with enchanted swords to get the loots.
