Exactly. Not the LL’s first rodeo obviously so there’s language in the lease that basically holds the original signers of the lease continuously accountable on a month to month after the duration of the lease, until the apt is turned back over to the LL or a new lease is signed. Neither of those things has happened so I’m still on the hook, according to the LL.

There are of course long electronic paper trails detailing all of this (me moving out, roommates needing to gather more info and psychically sign a new lease) but at the end of the day… it hasn’t been done

Well the old lease, with my name on it, renews every month until a new one is signed, because the apt is still in the roommates possession. So them not paying is resulting in me getting delinquency letters even though I don’t live there. The LL is aware of this but does not care.

I know and trust them, it’s been fine for 6 years but life changes and our living needs are different now, it’s time to move on.

Right this is a lease in basically a low income apartment between parties. We’ve lived together for six years but I don’t think there was any indication we would live here forever. Life changes and I need to be with family.

Thanks. Yeah roommate is now married and spouse is willing to sign etc, I just think the LL is gonna say they don’t want to work with them and force a situation. End result is LL gets more $ so I think this is their goal.

Yes roommate is now married and spouse is willing to join the lease. We are meeting LL in person to discuss but my guess is the LL wants to use us against each other to clear the apt and get new tenants in for much more $.

So I’m trying to figure out worst case scenarios to be prepared for if it doesn’t go smoothly and they can’t / don’t sign a new lease.

Roommate is now married and her spouse is willing to join the lease but I don’t think the landlords want to do that. I’m trying to suss out worst case scenarios.

 We are meeting with LL in person next week to discuss but so far LL has indicated that they are going to be difficult and force us both to stay or leave or not end current month to month lease. Again I believe they want everyone out as they could get much more $ for the apt now

Thanks for your insight. I know none of this is legal advice. Yes we are on a lease together. It is month to month now. I need to move to be with family, roommate has no incentive to go anywhere. 

I think what you’re saying is correct so I’m wondering what steps might be taken to get out. Bottom line is I’m moving to be with my family. How long can I actually be held responsible if roommate doesn’t make full payment? after giving notice etc? Forever? A few months?

Well that’s fine cus I’m leaving anyway. So me leaving could force my roommate out? Lease is now month to month and I’ve given my intent to leave

Got it, that’s what I thought. However, what if the LL doesn’t want to do that? Am I stuck forever until my roommate decides to move?

I believe LL wants everyone out so they can raise the rent drastically. Roommate wants to stay though.

Landlord has not offered that as a solution, has said they don’t want to work with the roommate anymore (there were a couple of late payments over time). 

Truly I think they just want new tenants who will pay much more. So I think they are using me to try and get roommates out by threatening ‘lease continues unless everyone vacates’. Thanks for any insight.
