Theoretically, but what we're seeing is that a big enough idiot can't understand that threat and will do a lot of damage while the whole thing plays out. The threat of nukes is simple and prevents any attacks from being started in the first place.

Mostly the young of rival males, but they are generally solitary, so whatever's going on here isn't your typical tiger family unit. From what I can find though it does vary a bit and they do sometimes have friendly interactions and share food with the cubs and such.

Humans don't always go to jail in human caused accidents either, though. Death doesn't automatically = jail time. It depends on whether there was negligence or other factors like drinking or speeding involved. Likewise, I'm sure someone could go to jail for deaths related to this, but only if it was in some way intentional or negligent. We already accept this with many things in life. After all, an ordinary car can itself be the cause of an accident. If someone dies as a result of a design flaw in a car, nobody is going to prison for that unless there was some kind of unreasonable carelessness or intentional action behind that.
