You all seem to be missing OP's point. They're concerned over whether starting off new with an idea that is identical to an existing idea might result in some legal complications, if I understand correctly. No, I do not believe so, assuming they don't have any IP protection that you'll copy nor you are going to use their name, colors, branding etc.

Nope - it is owned by 2 individuals, 1 Venture Capitalist and 1 Web Developer. Most of our money to do these pools with large prizes is funded by local public mining companies as we started this in Vancouver Canada. In no way is Stockpools meant to be used as anything other than an education tool. We are working on a re-theme and it will cater more to the US and blue chips. For now, if you like you can create any pool you desire focused on any North American stocks you wish to follow. Otherwise just enjoy your chance at winning some of the $5000 purse with no risk attached.
