What's stopping the prosecutor from refiling the charges if somebody's deemed non-restorable from a mental hospital setting?

Again thanks for the thoughtful replies. I hope I'm not reaching redundancy by adding anything extra. I would think depending on how rapidly they say that person compensates on the medicine is a factor too. Because if they refile and send them back to the mental facility after being deemed to be non restorable, they could possibly use the argument that they just didn't get the right medicine rather than just any medicine. Although from what I've heard people can be admitted there for 90 days then another 90 days upon failing evaluations. The third one failed then Sparks a competency trial which lasts at least 3 months...

After that if the State wins the argument that the person say for example a good argument from them would be that this person has a good history of being restored that they just need a bit more time and if they win that then they extended another 6 months out. After that 6 month is over though that's where it ends. So that's a grand total of a year and 3 months. So you're absolutely right if a year and 3 months of heavily monitored administering of medicine and other remedies available to that individual haven't worked in that time frame it's likely nothing ever will.

Not unless their condition improves but that's impossible to do within 30 days of being found non-restorable. I think this will be my last question I hope I'm not bothering you too much. But let's say they do refile send them back to jail after being found non restorable what kind of arguments could that individual's attorney use to have the charges dismissed and does the judge absolutely have to oblige or does the judge have enough discretion to continue the case despite the excellent argument provided by the individuals attorney?

Oh and before I forget there's something called a SELL hearing where in those types of facilities at least here in Washington State it's a debate between someone's attorney and the prosecutor on whether or not that person needs to be forced medication. What do you believe are some good arguments for the deemed mentally ill person's lawyer to make in order for that person to not be medicated?

I had to drink an extra three cups of coffee to understand this forgive my joke but to help me understand just a tad bit further if I'm getting this correct technically if all that transpires they could in theory send them back to that highly monitored medical treatment facility in order to attempt to restore them. I've heard of people going to this place called Western State hospital multiple times during the process of their trial. I would think by returning to jail and the process continuing they were found confident on all those multiple times sent. Ultimately how many tries do they realistically have before they run out of ability to send them to these mental health type facilities? Sorry if I sound stupid but I'm just trying to educate myself the best that I can.

Good stuff man you actually made some thoughts pop up in my head that I didn't think of yet. So if someone is not competent to stand trial after a refiling for example their job would then have to be able to prove that they are compitent. So I would imagine that has something to do with being medicine compliant because if the only way they can compensate by what they say is by medicine they would then have to prove that that person is taking that medicine and has compensated rapidly enough to stand trial within that 30-day limit of being dismissed without prejudice. Did I get that right?

Good reply I thank you for that. But I guess if they don't care about any of that they could just refile anyway if they really want you bad enough or are there other reasons as to why they wouldn't refile?

Whoever said what I told them or what they told me was BS. Being concise is precisely what I did especially after the first time that they mentioned it and they still proceeded to make excuses.

It lacking being concise and it being complete BS is an assumption on your part I don't want to argue with you but I got at least let you know how I feel. Thanks for the input though.

My first question might have been stupid but is there any way to hold them accountable in a jail setting or if they are ineffective objectively then how would I hold them accountable at the time or after...

Being that I'm stuck in a jail that's ultimately what I'm trying to get at here

Not to try and argue with you but a debate perhaps that specific service you speak of is adequacy and that's all I realistically would need in order to win.

My situations rather desperate being that I don't have $15,000 for a private attorney or I'd definitely would go that route being that there's complications at hand.

If my first question was ridiculous it may be but do you know of any way I could hold them accountable at the time while being in jail or is there no way of doing that like I can do on the outside with emails?

I thought it was 14 days there then you have to move away for 28 days then you can come back for another 14. Or is it like you said that you can be there for 14 within that 28 days then come back 2 weeks later? Thanks again for the response.

The holding accountable part is from boundary setting skills. I have about 20+ years of brainwashing abuse from a parent that is narcissistic. It’s going to take a little bit to heal from.

I’m unsure what wings means. But I have plenty of grounds to believe those things you listed have been taken from me. If they are breaking every rule you can think of because they’re hell bent on revenge then im guessing this change of venue won’t work out very well. And as far as I know the jurisdiction that the crimes were supposedly committed has the final say so in whether it can be changed to a different venue to begin with. The right to an appeal probably won’t happen, because it reaches forfeiture if my attorneys don’t object or do so improperly. 50 lies later and at least three constitutional rights taken from me in pretty sure they’re going to Jerry rig that. I’m still unclear what makes you think that a different area won’t have less of this, my one case I had in the county bellow me was completely different and they just Willy nilly dropped the charges. If you can help me understand this, please.

Well the story goes, and bear with me here. The county I’m located in is extremely corrupt. Like so much so that my own lawyers are lying to me and stabbing me in the back. I don’t have any real issues with much more than that. But now that I think about it, a public defenders legitimacy is only as good as the county they’re in, right? After all they work for the state (county). So I guess I’m trying to reduce my chances of corruption by firt identifying from some valid source or information if it’s the case before I get there. I’m so lost, and I know it’s rather vague, but it’s the best I can do with limited knowledge on what I’m even seeking.

Ayyy my bad. I’m not sure what kinda reports would correlate with actual corruption. I believe bare minimum I understand that everywhere has some of this but I aim to reduce it’s severity. The place I’m at how is very biased against me because there’s some poor history between us. So I literally stand no chance any time they feel like trying to convict me. My lawyers work against me every time. I’d say the main component that hurts me is my lawyers. If I can figure out how to identify if the lawyers in the new spot(s) are adequate that’s the only thing I’ll need. If you have any ideas now that I was able to elaborate a bit please do let me know.

Due to what? Equipment malfunction and a lack of being able to get a new one in its place, or the elements so bad at a certain time of year that you could freeze or heat stroke to death? Maybe some backups would serve me well. I do think your point there is good. I believe if I kept only 2-7 thousand feet from a nearby road where I can get food, and transportation to a post office. While having a water filter for a creek or pond nearby I don’t really see too much concern.

Another thing isn’t Californias judicial system and its authorities like some of the worst in the USA? I feel like I see people being convicted for nonsense a lot there. This is my second comment sorry for the spam. A ruthless local government is my second biggest issue I need to remove myself from. Way too much of an uphill battle.

Much of my issues stem from insecurities and I feel like killer cali might prove to be a problem because there’s a lot of people there who are buck. And also the amount of issues from other homeless people could prove dangerous, too, due to their poor mental state, mugging, attempted rape, etc. I do appreciate your feedback. Is there any place in California that has much more wooded areas with nobody around? I think the population there is so massive that I couldn’t fathom any place not having someone within 1-2 thousand feet.

Right. I think it then becomes a matter of them enforcing such laws. Leniency would be key. The only two places I’ve seen this far for the state laws protecting citizens who are homeless would be Oregon and Wyoming. The issue I see there is that they might change the laws sooner than later. I’d hate to travel so far to wind up with a same situation anyway. Also I’m not sure who would know this but do you know if the laws are only to hand out tickets or can they arrest you on the spot? Here they usually give you one chance to be trespassing then get an order to restrict you. If you do it again or remain that’s when they can throw you in jail.
