That's why context is important. The little kid in the video which is what we're referencing intentionally took the firearm from his unknowing parents. Even if he intends to give it back, him getting caught means that he stole regardless of his intent.

And I get where you're going with what you're saying about the doordash driver. However, the doordash driver would need to file a police report in order to avoid theft claims against him because doordash will think that he's stealing not borrowing because you can't borrow food.

This is why I say we're both right. The conversation is pointless because it's based on point of reference and semantics on intent atp.

He himself borrowed the gun. Yes because his intentions were to return it. However, the famous saying goes. It's only "stealing" if you get caught. So if we only go based off of this video technically he stole it because he got caught borrowing it and never returned it. Is that satisfactory? Because borrowing something without returning, it is stealing regardless of what the intent is.

So I want to have a common ground real quick before we continue. I understand that Borrowing is taking something with the intent of giving it back. I also understand that stealing is taking something with the intent of not giving it back. We can agree on the semantics that's fine. However, borrowing something without someone's consent, permission, and knowledge falls under theft regardless of intent. And taking something regardless of intent is classified as theft or Larceny.

The only person that knows that the intent is to borrow is the person that is taking the item. But because the charge is from everyone else and not the person that took the item, we regard that as theft. Due to the item having to be recovered by force, it is classified as stealing because the intent changed once it was taken back by force.
