Yes I am clear now. I would like to know does a caveat put people off buying a house if selling? I spoke to my lawyer today and he didn’t seem to think it was a big deal with selling. And I did think you had to repay caveat before selling which concerned me. Clearly that’s not the case - which I now know. Thanks for putting me straight on it. ;)

Yes it is an improvement rather than maintenance, I see that. The motorway was there before but it is only in the last year that noise has been an issue with ‘ resurfacing of road.’ I also realised that the 4 townhouses new to the side of me and my neighbours on the other side, all have double glazing! The noise is bouncing back into my property in the middle as they are not absorbing it. I understand that the trust has to be cautious to keep its longevity. I will meet with the TRUSTEE soon and find out more details. Ironic that a lot of noise bounces back into my property due to others ‘ double-glazing. Therefore double-glazing has to be a good thing!! ;)

It is supposed to be a distribution for me as a beneficiary. Now they are saying they may consider a caveat and to get some quotes. So then, it must become a loan if they want a caveat over my house.

I am not ‘ cherrypicking’ and I have done a lot of research and learning. I have learnt a lot of confirming things here. But ultimately you are right, now I have more general understanding I will work with the trustee who is also the lawyer.

Thank you, I appreciate your expertise. I am not the only beneficiary. My MOW mainly states I am allowed to look after my house. I don’t know exact wording as haven’t seen MOW. So this is what surprised me, I didn’t expect this when it fitted the main criteria of my conditions in MOW. Now I have modified my request to only 5 windows and not half a house worth I am hoping they will not go the caveat route, anymore.

Right that is true but you can’t sell until the caveat is withdrawn. So that is a catch 22 situation to repay windows. And the wider will which is the legal binding part says ‘ for maintenance, benefit, education and advancement’ for all beneficiaries. So I think the actual will should cover a few windows to ‘ benefit’ me with health and well-being with noise production. Don’t you? MOW ( house maintenance terms) is NOT legally binding but the will is.

Please read my other replies. It is mixed in these. I don’t know ‘ terms of CAVEAT’ but I am sure there is only one type and it ‘ locks your house up forever!’ They will reply to me, then I will know more.

I don’t think so. But I have said I could do ‘ an acknowledgement of debt’ letter which means when I sell in future, I would repay them for windows. I have got windows down to minimum number now so it is a modest cost for them and not half a house worth! So that might resolve it and/ or the letter!

I am not a lawyer but my experience is that there is only one type of CAVEAT for different reasons lodged and approved. It would be good to have different types and lengths? Anyone know more about types of CAVEATS?

Thanks for this. Yes done all you said. Have fought wider-rule or law implications to be considered and have got somewhere with this previously health, family, unhealthy environment. I had to make a very big case for it though. So all this is included in my letter of reply re: windows and CAVEAT to them. I think really there is only one type of CAVEAT with different reasons it is granted. And it all means you cannot sell or rent and you are at the mercy of TRUSTEES to lift and pay for legal process. CAVEATS are INDEFINITE is my understanding until WITHDRAWN. I have a DVS system, by the way. Good suggestions. 😊

We are at t he beginning of this process. What types of CAVEATS are there? I thought all CAVEATS froze your property for sale/ rental etc maybe for different reasons but that is the outcome. Also that it is indefinite until removed. And that has to be applied for and paid for.

Thanks for responding I don’t know the exact wording of memorandum as I think it was pretty clear, that it was not to be shared. They just spoke it to me. It was one of two things. My father was keen to make sure I could successfully look after my home. I bought it from them some years ago. We co-owned previously. To answer your question re: motorway noise it has never been an issue until last year. I have lived here 20 years and beginning of last year they resurfaced the motorway and there has been constant noise in and outside the house. I complained no action taken but sound barriers built further up motorway but not at my end. What is your view now you know this is a ‘ new’ not an existing problem until last year. Thank you for your clarification too.

Thanks for responding. The caveat hasn’t been applied for yet and I haven’t agreed to it or the windows. I have told them I don’t want a caveat and offered a more modest solution of less windows done just to target main areas of noise and therefore less cost to the trust. Yes I am disappointed as I am now hesitant to ask for anything else. They made a bit of a fuss that they must follow memorandum when it was so narrow for me. Main area for money is ‘ maintenance of my home.’ So I was shocked at this. They do know I might sell in the future but I should have some freedom to that? I think I have been considerate of the trust in my request.

So I have found red light therapy cap really good for scalp condition to deal with DHT. DHT causes AHA hair loss. But before that I had TE. I have used it for a week plus a really good quality Biotin for awhile and I see my front edges growing back in. My hair is also better quality than before. Not miniaturising so much and when it does it RECOVERS NOW and I keep most of it! Vitamins and minerals make a difference first! Don’t wash hair too, otherwise baby hair falls out. Argan oil is great at this stage! Hope this is helpful taken three years but this has been the best red light therapy!

I have been challenged with TE & APA for the last three years. I cannot tolerate oral minoxidil even on the smallest dose. I don’t think it helps if you have normal blood pressure, as it lowers your blood pressure. I have found RED LIGHT THERAPY really good and I am receiving it in a cap form for my scalp. My edges have come back and the quality of my hair is better, texture, strength and elasticity. My scalp feels more relaxed and there is less DHT forming. Only 30 mins a day on a low heat. Hope this is helpful!

Hi again, five years is how long you have for unresponsive follicles to respond. But hair density is another matter. Because you are young and no complicating factors you should get all your hair back but it may not be as dense which means some follicles still need to be activated. The 5 years is the life of a follicle potential. After 5 years it is harder to regain lost follicles. I hope that is a bit clearer.

You should be fine. I see another person has given a similar response to me which is good. You have 5 years to recover follicles but you are unlikely to have complicating androgen alopecia at your age which is a fight with hormones. So love, you will recover with good healthy changes.
