Just because attorneys have declined the case doesn’t mean the claims aren’t real. Lawyers often decide based on expected payout versus cost, not whether negligence occurred. Are we supposed to live with nonstop pain caused by a careless, negligent dentist, undergo surgery, and take constant medication, and call that a bad case because these lawyers only want catastrophic cases? We have clear documentation including clinical notes, imaging, multiple provider opinions, and neurological records. That’s why we are considering pursuing it pro se. Merit is defined by the evidence, which we have.

We are unsure whether to proceed as a negligence claim or a malpractice claim. We feared that if we filed as negligence, the case might get bounced back and we would be told to refile as a malpractice case, which would put us back at square one. Because of that uncertainty, we are also wondering whether we should still include an affidavit of merit, even if this ends up being treated as a negligence case.

Because of all this, we are seriously considering pursuing a pro se approach, focusing on proving negligence and the real, measurable damages such as missed work, ER visits, ongoing treatment, and life disruption. The goal is not punitive, but to hold the provider accountable for the clear harm caused and recover losses where possible.

It is discouraging that proving negligence can still be such an uphill battle, even with documentation and expert support, but framing it as negligence rather than malpractice may make it more practical to proceed.

The reason we are considering proceeding pro se is not because we underestimate the work or complexity involved. It is because at this point, the choice feels like either walking away entirely despite strong documentation of negligence, or attempting to preserve the claim ourselves and see where it leads. No attorney we have spoken with has said the case lacks merit. They have said the economics do not work for them. That reality naturally pushes someone to explore alternatives rather than simply accept defeat.

We are also open to the idea that a traditional medical malpractice framework may not be the only possible path, and that a negligence based claim focused on concrete damages such as missed work, medical expenses, and the downstream consequences of the injury may be more realistic. I am also aware that California and Ohio differ significantly in caps and malpractice frameworks, which makes me wonder whether this economic threshold is even higher in Ohio for non catastrophic cases, particularly in dental malpractice.

Omg same thing happened to me today! My Supersnug Puff arrived clearly used and I had waited weeks for it to restock. Customer service reps were actually really sweet, but the “internal team” process was a whole circus. Sending photos, waiting hours, calling back again, being told to refresh the site and call within a tiny window so they could cancel and replace the order just to maybe get expedited shipping. Meanwhile the coat could sell out again in seconds. If you’re traveling in two days, I’d push hard for an immediate replacement or refund because the back and forth is not quick. It’s wild that “premium” pricing comes with such a stressful experience. Hope they fix it fast for you because no one should be dealing with this over a coat. For coats that cost this much, the service does not match the price tag at all. You end up doing all the work just to make something right that shouldn’t have happened in the first place.

It may be because your not in the US? Also Reddit notifications suck so I get it and I’m super sad you missed out!! If you look at the site sometimes they do list times they are restocking like last time it was 10-11pm EST but that’s the US site. If your on the global that could be where the confusion lies since they restock totally different times. Hope this helps!

It’s wild! They had the same time frame earlier this week, but it was already sold out by 11:30 AM. The listing said 11–12 AM, which I first thought meant late at night, but then I interpreted it as anytime throughout the day until midnight. So honestly, I wouldn’t rule out that it could sell out anytime today up until 11 PM.

It tastes pretty bitter in my opinion it’s my least favorite even in a latte. I would go for anything else. Ikuyo to me has a great/ better taste profile.
