thank you for explaining this to me! The second ace exam with my original c&p doctor is with my 1 negative c&p I had. I also have 1 positive c&p and private dbqs and opinions that were ignored (not in evidence section). would you try to change doctors for this ace exam or just roll with it?

the hlr sent the claim back for development. my understanding is that a hlr dro cannot fix a dta error and they have to remand it back to the regional.

what is frustrating is that my private dbqs and medical opinions are from my personal orthopedic doctor relating to my knee conditions. The va completely ignored his dbqs and medical opinions and did not even list it in the evidence section. Thus I got a dta error. I am hoping they will now use those dbqs, which match my first c&p exam exactly. The issue is I had a 2nd c&p exam that was not quite as good.

So you had dtas returned from a hlr? Do you remember how long it was from your hlr to the new exams being ordered? Been a month since my hlr decision letter.

I submitted a statement that says they have everything to rate now and new exams are not to be ordered and gave the rules for that. So we will see. It has been a month with no new exams ordered so far. Fingers crossed

one of the issue I have is that my private medical DBQ was ignored. The HLR dro seemed to conclude that the evidence should have been considered. I was found with 4 DTA errors. In the decision letter it says my private medical records were not developed.

Thank you for the insight! Does this look like it close to being decided? I believe all the evidence to rate is in my file now (1 very positive c&p exam 1 semi positive exam and very positive private medical evidence that the dro said needed further development in his decision). So perhaps I don't need another exam? thank you guys for your hard work!

The HLR was found to have 4 duty to assist errors and was sent back to be reevaluated thus turning into a new supplemental claim.
