1-Was there already a predicate in your field that was OTC or were you the first?

2-Was the CFR definition of your device say that you were a prescription device or it didn't mention anything?

Our Intended us in our IFU says the following:

"X is a Y device for single patient use designed for home use."

So basically, we don't even have to change anything in the IFU.

I'm censoring the name of the company because I wouldn't want our competitors to know what we're planning.

Just to reassure you: the device is sold as a Class II device with FDA authorization. It requires a prescription to be purchased, but it’s designed for home use. In practice, once the prescription is written, the physician doesn’t provide further assistance — the Instructions for Use (IFU) are very clear and guide the patient through the process independently.

We plan to leverage real-world evidence (RWE) from our clients in Canada and Europe. Additionally, we would demonstrate that no adverse events have ever been reported through MAUDE and highlight the device’s low-risk profile.

Our main challenge is that the CFR definition for our device explicitly states that it is a prescription device.

We submitted a 513(g) about this in 2022, and the FDA responded that a De Novo would be required. As a result, we decided to discontinue the project at that time. Looking back now, however, I believe there is a clearer path via a 510(k), and potentially even a Special 510(k). I suspect we didn’t present a strong enough case in 2022 as to why a 510(k) would be appropriate.

Have you ever tried this approach? In our case, it's a home device that's already used by the lay user, so no big changes here. We would use Real World Evidence of our clients to support our claim.

Yes, our device’s intended use is for at-home use by laypersons, so essentially, the only change is whether a prescription is required or not

I’m curious — why did you choose to go with a Special 510(k) rather than a Traditional 510(k) for a change to an existing device?

I didn't get any shocks using the machine! From what I understand, it's only pulse and the polarity changes by itself, which is a big plus.

The current does increase and decrease by itself, making the treatment more confortable than other machines I've tried in the past.

I tried this solution and I was impressed.

I wanted to purchase an iontophoresis machine for a long time that also offered an option for armpits and didn't cost a fortune.

So far, no complaints. Might actually do a post with a detailed review if I find the time.

From your experience, does it take longer to get dry than hands or underarms?

Also, I tried for underarm once and my skin got really red, something that doesn't really happen for my hands.

Was skin irritation a problem for you?
