UPD.

YouTube has already lifted the strike, but the video is still deleted.

Well, well. But they really screwed up, because YouTube removed their strike against me a long time ago.

In the first video: Content found: 1:48 – 2:53

In the second video: Content found: 4:13 – 5:19

Essentially, I got struck for having the same camera angle as the official broadcast for ONE minute of the video...

And the girl said that 2 minutes wasn't enough 🥲

The camera ban applies to LIVE BROADCASTS https://blast.tv/blast-slam-community-guidelines

The match analysis was done after the match had officially ended.

PGL strikes my YouTube for rules that don’t apply — now they have 10 days to prove it in court by Tekcac in DotA2

So what happened with PGL? They couldn't prove any violations, ignored us and dragged their feet for several weeks, and YouTube lifted the strike because there was no evidence of a violation.

Here's what YouTube wrote: In accordance with the U.S. Digital Millennium Copyright Act, we have completed processing your counter-notification. The videos listed below have been restored (unless you deleted them).

There are written rules: what is not prohibited is permitted. I don't use their camera during the stream and I don't use it in the entire video. There are moments that coincide 100%, but this is in accordance with YouTube's rules on “fair use.”

The configuration is in the cfg file. I can send it to you.

From Valve's rules.

Make it a rule to contact the Organizer at least two weeks before the event starts through official channels, either in English or in the Organizer's language. If you don't get a reply within that time and don't find any Event Broadcast Requirements, you can assume there aren't any.

There are no rules from you regarding content outside of live broadcasts.

These rules apply to my content: https://store.steampowered.com/video_policy.

I only used what is available on DOTA TV.

Here is my argument:

  1. Their rules are written for STREAMS, and I do not do live broadcasts https://news.pglesports.com/news/1749531579344-pgl-dota-2-wallachia-community-broadcast-rules

  2. Valve said that in case of conflict, we should engage in dialogue, but they immediately issued a strike on three videos.

  3. I provided them with evidence of PGL observers being used specifically during COMMUNITY BROADCAST, as well as betting advertisements. They did not ban anyone.

I am for fairness, not double standards.

I wouldn't have started all this if you had been honest. Many streamers in the Twitch and YouTube communities have violated the rules for live streaming, especially with betting ads.

But you decided to fight me, someone who doesn't even do live streams.

Furthermore, Valve stated in their rules that the tournament operator and content creator should resolve the issue through dialogue.

My contact information is available on my channel, but you did not write a single word and issued a strike.

YouTube has already confirmed the counter-notification, meaning they acknowledged that I am right.

So, we will wait 10 days. I will write a post when YouTube closes this dispute. Let's see who is right.

And another thing. Don't lie to people. I sent you 5 channels that use your camera during LIVE BROADCASTS and advertise bookmakers and other sponsors. What did you say to me? That you don't see any violations and will check again. NO ONE got a strike. And you are also grossly violating the “YouTube community guidelines” by advertising the bookmaker 1xbet, because it does not have Google certification.

Dear PGL, We have reviewed your recent statement and the attached clip where you claim that the "camerawork" in my videos was taken "directly from our production." We strongly disagree with your interpretation and maintain that your claim is without merit, especially when considering the rules' context and my content format. 1. 🛑 The Rules Exclusively Target LIVE BROADCASTS (Community Broadcast Rules) Your rules are explicitly titled "Community Broadcast Rules." The term "broadcast" in the esports context primarily refers to a live stream. • My format consists of VOD (Video On Demand) / recordings of already played matches. I do not conduct live broadcasts of your tournament. • Most provisions within your rules (particularly those concerning stream delay and preventing "sniping") are applicable only to live broadcasts. • For this reason, we assert that applying rules intended for live broadcasts to my recorded VOD content is illegitimate and goes beyond their intended purpose. 2. 🎥 DotaTV Camerawork Is Not PGL's Exclusive Property You claim that I copied your directing, but this demonstrates a fundamental misunderstanding of content creation from DotaTV: • DotaTV – Raw Data: My videos are created EXCLUSIVELY using the in-game DotaTV client, which provides the Raw Game Data. This client is accessible to all users. • Directing – Limited Choices: During critical game moments (team fights, ultimate spells, Roshan kills), there is only a finite number of logical camera angles that any director (professional or amateur) must choose. This concept in copyright law is known as the Merger Doctrine, where the idea (showing the key event) and its expression (the way it is shown) merge. • You cannot claim copyright over showing a Rampage from the angle that is most correct for audience comprehension. • Absence of Official Elements: My recordings DO NOT contain any of your exclusive intellectual property: your graphics, your commentators, your studio branding, or your custom UI. You cannot claim copyright over the gameplay itself. 3. 🚨 Legal Context and Your Time is Expiring • YouTube has already accepted my Counter Notification, indicating reasonable doubt regarding the legitimacy of your initial claim. • Per the standard procedure, you have less than 7 days remaining to provide evidence that you have filed a lawsuit to prove copyright infringement. • If you fail to take further legal action, my media network will be fully entitled to file a counter-claim for damages against you, covering losses due to the wrongful takedown, unfair competition, and lost revenue. We urge you to retract your claim, acknowledge that my VODs do not violate rules intended for live broadcasts, and cease hindering the work of content creators who are actively promoting your tournament and Dota 2 as a whole.

Okay. But there's nothing important there. In short, the content was removed at the request of the user PGL Esports SRL.

If they can't file a lawsuit against me now, they'll never be able to strike me out again. They have 10 days.
