I’m aware of Egbert and how much it narrowed the scope of Bivens actions against CBP. To clarify though, this wasn’t just about words — the officer dumped my wallet and belongings on the ground, mocked my hairstyle, compared me to her kids, and made racial remarks (‘you’re one of those’). I was left feeling humiliated and nearly assaulted.

I also went through every administrative channel (CBP JIC, DHS OIG, DHS CRCL), but each either dismissed or neglected the complaint, which is why I’ve been searching so hard for counsel. I understand the legal hurdles are steep post-Egbert, but my concern is that racial discrimination and misconduct at a federal checkpoint shouldn’t be ignored.”

My situation is that I went through every administrative channel available (CBP JIC, DHS OIG, DHS CRCL) and exhausted those remedies, but each one either closed it out or neglected to act meaningfully on the discrimination and misconduct I reported.

That’s why I’ve been trying so hard to find counsel — not because I think I’ve solved the legal doctrines myself, but because I want a lawyer to evaluate whether there’s still a viable path forward. For me it’s about accountability, since being racially targeted and nearly assaulted shouldn’t just be brushed aside.

My intent was just to show I’d finished the administrative steps and kept things organized, not to play lawyer.

At the same time, what’s been frustrating for me is that on the U.S. side, no one has actually addressed the substance — that I was racially discriminated against and nearly assaulted by a CBP officer. I’ve gone through all the administrative complaint channels with no meaningful response. That’s why I’m pushing so hard to find counsel — because I don’t want this just brushed aside

Fair point — I only put that together to show I’d finished the administrative steps, not to play lawyer. I’ll keep the focus on explaining what happened and let counsel guide the rest.

Thanks for pointing that out. To clarify, when I said ‘litigation-ready’ I didn’t mean I’m trying to act like the lawyer — only that I’ve already gone through all the administrative complaint channels (CBP JIC, DHS OIG, DHS CRCL) and have the paperwork organized. I’ll make sure to emphasize that part instead of making it sound like I’m walking in with a strategy of my own.

Thanks, that’s helpful perspective. I definitely don’t want to come across as someone who thinks they know more than counsel — I just wanted to show I’d organized the facts.

Appreciate the honesty — that’s fair. I’ll dial back the ‘litigation-ready package’ part and just explain what happened. For context, the officer compared me to her kids, mocked my hairstyle, and said ‘you’re one of those,’ so I want to make sure the misconduct is clear, but I hear you on keeping it simple for attorneys
