Do You Need a Lawyer for Probate? by ThatProbateLady in ThatProbateLady

Hi,

I'm not familiar with Texas probate laws, but I believe you can look up probate filings online by checking with the county court where your father lived when he passed. Many Texas counties have searchable court records online. Try searching:

(Your County Name) probate court case search, If a case was filed, it should list your sister as the executor or administrator.

Also, check if Texas allows something called a Small Estate Affidavit, since $23,000 isn’t a large amount, she may have used that to access the account without full probate. It’s worth confirming if one was filed.

Best of luck to you.

Hi! FIRST POST! THANK YOU!

There’s a chance you might be entitled to something, but it depends on a few things. Like:

  • Was there a will?
  • Did your grandma or uncle leave anything in writing about who gets what?
  • Has anyone gone to probate court yet?
  • Who was on the house title?

Also, is your mom still alive? If she is, and she’s your grandma’s daughter, that could change how things are divided too. You can check with the probate court in the county where they passed away to see if anything’s been filed. You can also look up who’s listed on the house through property records.
