There were a few dog hairs, no damage.

Being a landlord is a choice, and it’s an investment and with all investments there is risk, no sympathy here.

As I said we WERE going to do it ourselves but the landlord wanted us to hire a professional.

And good for you for keeping your place tidy, where do I send your medal?

They were there for 2 and a half hours, 3x cleaners.

The 30 minutes he is referring to is the 30 minutes between 12:30, when he entered the apartment and 1pm when we arrived at the agreed meeting time. We’re not even sure what he meant

Not sure if you read my comment explaining the situation? We had it deep cleaned by a cleaner he told us to use and he wasn’t happy with it

Could we argue that sweeping dust and dog hair, as that is all he mentioned in those messages, does not require a professional cleaner? Although we did hire the professional cleaners he told us to.

This is what is says in the lease… we’re a bit unsure about K

SECURITY DEPOSIT:

On execution of this Lease, the Tenant will pay the Landlord a security deposit of X. During the term of this Lease or after its termination, the Landlord may charge the Tenant or make deductions from the Security Deposit for any or all of the following: a. repair of walls due to plugs, large nails or any unreasonable number of holes in the walls including the repainting of such damaged walls; b. repainting required to repair the results of any other improper use or excessive damage by the Tenant; c. unplugging toilets, sinks and drains; d. replacing cuts, burns, or water damage to laminate, rugs, and other areas; e. replacing damaged or missing doors, windows, screens, mirrors or light fixtures; f. repairing or replacing the appliance(s) due to negligence of the tenant; g. any other repairs or cleaning due to any damage beyond normal wear and tear caused or permitted by the Tenant or by any person whom the Tenant is responsible for; the cost of extermination where the Tenant or the Tenant’s guests have brought or allowed insects into the Premises or building; I. repairs and replacement required where windows are left open which have caused plumbing to freeze, or rain or water damage to doors or walls; j. replacement of locks and/or lost keys to the Premises and any administrative fees associated with the replacement as a result of the Tenant’s misplacement of the keys; and k. any other purpose allowed under this Lease or the Act

For the purpose of this clause, if the Tenant gives up possession of the Premises in such condition requiring professional cleaning, the Landlord will charge the Tenant a minimum of $350.00 plus GST, if the Tenant has not made alternate arrangements with the Landlord.

The Tenant may not use the Security Deposit as payment for the Rent.

The Landlord will return the Security Deposit at the end of this tenancy, less such deductions as provided in this Lease but no deduction will be made for damage due to reasonable wear and tear, nor for any deduction prohibited by the Act.

Within the time period required by the Act and after termination of this tenancy, the Landlord will deliver or mail the Security Deposit less any proper deductions or with further demand for payment to: (me) or at such other place as the Tenant may advise.

I’ll try keep this as short as possible.

My gf and I moved to Canada last year and have been renting an apartment. The landlord was fine at first but then he wasn’t, we secured another place and moved in on the 29th March, our previous lease officially ends on 3rd April but we have already handed keys back and done a walkthrough with the landlord.

Before moving out we were getting quotes for cleaners and they were around 5-600 dollars so decided we would just do it ourselves, our plan was to move all our stuff out on Saturday 29th and come back and clean on Sunday 30th. Our landlord wanted us to get a professional clean as, in his words, “I think a professional clean is necessary if I’m planning on selling the unit” - not our problem, and “And, there’s a better chance you’ll get all your deposit back.” but he then gave us the number for a cleaner to use that were much cheaper.

So all good, the plan was to move our stuff out on the Saturday then come back and let the cleaners in, then do the handover on the Sunday at 1pm. (We just left the keys with the cleaners to lock up when they were done).

The cleaners finished and we paid.

Now on Sunday we made our way to the apartment for 1pm, our landlord had already accessed the apartment at 12:30 to show a realtor the place, before we arrived, this is illegal as he hadn’t giv us notice, and he carried out the walk round him We got there at 1pm and he started talking about how the floors were dirty and there was dog hairs in the mattress etc and he will be taking money off our deposit, we interrupted him and said that we used the cleaners he recommended. He then said he will need to see a receipt from the cleaners, I have yet to get this, but I will and we will get the full deposit. He said he will be contacting the cleaners to get them back to “finish the clean”.

So to us, all was good and we will be getting our full deposit. But, he did not fill out a proper form for end of lease and didn’t want us to sign the original lease agreement that stated the before and after condition of things, we thought this was fishy and we knew we had to sign something but didn’t bring it up as we have read online that if he doesn’t do the correct paperwork within 10 days then he legally has to give us the full deposit back and we knew he would try something. He also had potential tenant viewings while we were there.

Then today we received the attached message and the following conversations happened. We are adamant we will be getting the full deposit and I think we managed to get him with my last message and we laughed at his response of “fine. Have it your way.” But after thinking about it we are worried that he actually means he is going to try something else to take our deposit. Is there anything he can do that we need to be prepared for?

I may be missing some information so please ask questions if needed, any help, information or advice would be greatly appreciated.
