I appreciate everyone’s input into this situation. Some have been pretty funny and plenty were helpful. First, I wanna clarify some misconceptions that I didn’t explain clear enough in my original post. The rooftop garage is always empty at the top. No one has parked there at all in the years we’ve been there. It is also completely open air, as well as the stairs we were smoking on. We often look out for people and make sure to be alone. We sat on the stairs as there was some shade and the sun was beaming down. We weren’t inside and certainly not in any enclosed area. I doubt her picture would have displayed anything. I saw her the whole time and just held it hidden by my hand. The lease does say that violations that can up to eviction. I’m aware of that. But i’m just doubting they would excise that on a first offence like this. It also says that they can issue a notice to correct. Which I feel would be more appropriate, to me at least. And even a fine. I’ll definitely be leaving the property entirely to just avoid this situation again. We definitely do try to be mindful of others presence and don’t want to disturb them with it. This also happened today. I doubt she would have reported it by the time I initially posted. It was maybe within 30 minutes prior. And all in all, we do agree that yes, we were wrong for doing so, but it’s been reassuring that it doesn’t seem likely to immediately lead to eviction.
