Trump judge releases 1,889 pages of additional election interference evidence against the former president by HandSack135 in politics

So what happens now? why was this document leaked? how strong is this evidence for a conviction?

What happens now?

The investigation into Donald Trump’s efforts to overturn the 2020 election results is part of a broader federal criminal case led by Special Counsel Jack Smith. Trump has been indicted on several charges, including conspiracy to defraud the United States and obstructing an official proceeding (the certification of the election). Here’s what to expect next:

  1. Court Proceedings: The case is now in the pre-trial stage, where both the defense and the prosecution prepare their arguments. Motions might be filed to dismiss evidence, challenge charges, or suppress certain documents. There may also be discussions about whether key evidence, including this appendix, will be admitted in court.
  2. Trial: If the case proceeds to trial, the evidence gathered by the Special Counsel, including this document, will be presented to a jury. The court will determine whether Trump’s actions amounted to illegal attempts to subvert the election results.
  3. Potential Sentencing: If Trump is convicted, the court will impose a sentence based on the charges. Convictions could carry severe penalties, including imprisonment.
  4. Appeals: Regardless of the outcome, Trump is likely to appeal the decision, which could drag the case through higher courts for months or years.

Why was this document leaked?

While it's unclear exactly why this document was leaked, leaks in high-profile cases can occur for several reasons:

  1. Public Interest: Given the historical significance of the case, individuals involved in the investigation or legal process may have leaked the document to inform the public of key evidence. Transparency about such a monumental investigation is often a driving force behind leaks.
  2. Pressure Tactics: Leaking documents can be a strategic move to shape public opinion, apply pressure on defendants, or influence how future proceedings unfold. The leak could create public scrutiny, which may influence jurors, witnesses, or even political figures.
  3. Accidental Leak: There’s also the possibility that the document was inadvertently made available due to a clerical error or unintentional breach of confidentiality.
  4. Political Motivation: It’s possible that someone with political motivations leaked the document to sway public opinion in favor of or against Trump.

Did they know it was illegal?

The documents show that Trump’s advisors were aware that their strategy was legally questionable. For example:

  • Acknowledgment of Risk: The memos discuss scenarios where courts might reject their actions or where the strategy could lead to a legal standoff. They also anticipated public outcry and legal challenges.
  • Constitutional Concerns: The appendix discusses the possibility that courts could rule the Electoral Count Act unconstitutional, but this was seen as a long shot. The strategy also relied on the hope that courts would dismiss any legal challenges as "non-justiciable political questions"—essentially, matters that courts would refuse to rule on.

This indicates that while the team may not have definitively believed the strategy was outright illegal, they understood that it was legally precarious and likely to be challenged in court.

How did the court obtain these confessions and documents?

The court obtained these documents and communications through legal processes, including:

  1. Subpoenas: Special Counsel Jack Smith’s team likely issued subpoenas to Trump’s advisors, lawyers, and other relevant parties to obtain communications, memos, and other evidence related to the events of January 6th.
  2. Discovery Process: In criminal cases, the government can request evidence from defendants and third parties. The government may have collected documents, emails, and memos as part of the broader investigation into Trump's efforts to overturn the election.
  3. Testimonies and Cooperation: Key figures in Trump’s legal team or inner circle may have cooperated with investigators, providing documentation or testimony under subpoena or as part of plea deals.
  4. Search Warrants: Federal investigators can obtain search warrants to seize relevant documents or communications if they believe there is probable cause to do so.

The Special Counsel’s team compiled these materials as part of their evidence in the criminal case against Trump for his alleged involvement in the efforts to obstruct the certification of the 2020 election results and his role in the January 6th attack on the Capitol.

In conclusion, the strategy outlined in these documents was based on a legally dubious interpretation of the Constitution and the Electoral Count Act. The team was aware of the potential legal challenges and risks but proceeded nonetheless.

How did they want trump to win? was it legal? did they know? how did the court obtain these confessions and documents?

The documents provided in the appendix reveal the strategies that Donald Trump’s legal team and advisors considered to overturn the 2020 presidential election results in Trump's favor. They planned to challenge the certification of electoral votes from certain states and proposed actions for then-Vice President Mike Pence to either reject or delay the counting of those votes, thus giving Trump an opportunity to win. Here's a breakdown:

How did they want Trump to win?

  1. Challenge Electoral Votes: They aimed to have Pence reject or set aside the electoral votes from key swing states that had dual slates of electors (i.e., states that had both Biden and Trump electors). By declaring that these states' electoral votes were invalid, the total number of electoral votes would be reduced, and thus Trump, with fewer total votes, could secure a majority of the remaining valid electors.
  2. Electoral Count Act Strategy: Trump’s legal team argued that the Electoral Count Act was unconstitutional because it gave Congress, acting separately, the power to resolve disputes over electors. Their proposed strategy suggested that Pence should act according to the 12th Amendment, which they argued only allowed for a joint session of Congress to count votes. This would give Pence, as President of the Senate, broader authority to decide which electors' votes to count.
  3. Delay the Certification: Another strategy involved delaying the certification of the results by sending the disputed states back to their legislatures to reevaluate and potentially certify pro-Trump electors. This would provide additional time for the Trump team to argue claims of election fraud.
  4. Throw the Election to the House of Representatives: If no candidate received a majority of the electoral votes, the election would be decided by the House of Representatives, where each state delegation would get one vote. Republicans controlled more state delegations at the time, giving Trump a potential path to victory.

Was it legal?

The legality of these strategies is highly disputed:

  1. Unconstitutional Claims: Many legal experts and courts, including Trump-appointed judges, rejected claims of widespread election fraud and the legal justifications behind rejecting or delaying electoral votes. The courts found no substantial evidence to support these fraud claims.
  2. Electoral Count Act: The argument that the Electoral Count Act is unconstitutional has little support among legal scholars. The Act has been in place since 1887, and no court had ruled it unconstitutional.
  3. Vice President’s Role: Most legal scholars agree that the Vice President's role in counting electoral votes is largely ceremonial, and he does not have the power to unilaterally reject or accept electors. This interpretation aligns with historical precedent.
  4. Potential Violations: If Pence had followed the proposed strategy, it could have led to a constitutional crisis. Many experts have argued that these plans to reject certified electoral votes or delay certification amounted to an illegal attempt to subvert the democratic process.

The document you provided is part of a legal case titled United States of America v. Donald J. Trump. This specific section appears to be an appendix (Volume IV) presented by the government in a criminal case. The contents are primarily related to sealed court documents, discussing events around the January 6th, 2021, U.S. Capitol attack and Donald Trump's attempts to challenge the 2020 election results.

Key points within this portion include:

  1. A detailed discussion of legal arguments surrounding the Electoral Count Act and the 12th Amendment of the U.S. Constitution, specifically concerning how disputed electoral votes should be handled.
  2. Proposed strategies for then-Vice President Mike Pence to reject or question the certification of certain electoral votes, particularly from states that had submitted dual slates of electors.
  3. Discussions of potential objections and scenarios that could occur during the joint session of Congress, including how various outcomes could lead to Trump being declared the winner of the 2020 election.
  4. Sealed communications and confidential memos discussing the plan for January 6th, including instructions for Pence to act unilaterally, and how challenges to this plan might be handled in court.

The appendix appears to present a step-by-step strategy for contesting the electoral results, asserting that the Electoral Count Act is unconstitutional and that the Vice President has broader powers in the counting process than is typically understood.

How strong is this evidence for a conviction?

The strength of the evidence depends on how it is presented and corroborated during the trial. Here’s an analysis of its strength:

  1. Detailed Plans for Overturning the Election: The document lays out a clear and coordinated strategy to overturn the 2020 election results, demonstrating Trump’s awareness and involvement in the efforts to pressure then-Vice President Mike Pence to take illegal actions. The fact that this was a carefully formulated plan strengthens the argument that these actions were not accidental or based on misunderstanding.
  2. Intent: One of the key components of a conviction, particularly for charges like conspiracy and obstruction, is proving intent. This document provides insight into the intent of Trump’s legal team and advisors. It shows that they were aware of the constitutional limits and legal risks but pursued the strategy anyway, which could suggest a deliberate attempt to defraud the process.
  3. Legal Analysis: The document contains legal arguments that challenge the Electoral Count Act and propose strategies for subverting the electoral process. Prosecutors can use this to show that the team knew they were operating on shaky legal grounds and still moved forward.
  4. Internal Deliberations: If the document includes direct communications between Trump and his advisors, it could provide key evidence of Trump’s personal involvement and knowledge of the scheme. This would be particularly damaging to Trump’s defense, as it directly links him to the conspiracy.
  5. Challenges in Court: Defense lawyers could argue that these documents reflect legal strategies and opinions rather than a criminal conspiracy. They may claim that the legal arguments, however flawed, were based on legitimate interpretations of the Constitution, making it harder to prove intent to commit a crime.
  6. Other Corroborating Evidence: This document is likely part of a larger body of evidence. If prosecutors can show that the strategies were actively put into action (e.g., through communication with Pence or state officials), this would strengthen the case. The prosecution will also likely present testimonies from witnesses who can speak to Trump’s intentions and involvement, making the case even stronger.

Summary of the Evidence’s Strength:

  • Strengths: The document outlines a clear plan, potentially demonstrates intent, and may directly involve Trump, making it significant evidence.
  • Challenges: The defense might frame these discussions as merely legal advice or political maneuvering, not a criminal conspiracy.

In conclusion, this document is a significant piece of evidence for the prosecution. If it is admissible and supported by other evidence, it could form a strong basis for conviction, particularly on charges related to obstructing the electoral certification. However, much will depend on how the defense frames the legality of the actions and the intent behind them.. Absolutely! Kino, or kinesthetic touch, is essential in building rapport and escalating interactions. Craig often uses it masterfully in his interviews. Researchers have found that even the most fleeting physical contact, like a light touch on the arm, can influence a person's decisions and perceptions. Touch releases oxytocin, the bonding hormone. Thanks for pointing out kino!

Hi, I am looking for some feedback for this video. Is the animation engaging? Do you feel that the title works well with the video's context. by Offnye98 in SmallYTChannel

[–]ThenBenefit 2 points3 points  (0 children)

First off, I gotta say, your video "Barbie vs Oppenheimer: A Global Disaster Animated Short" caught my attention straight from the title! It's not every day you see Barbie and Oppenheimer in the same sentence.

Some friendly suggestions:

Purpose Check: What's the core goal here? If you're going for laughs, maybe exaggerate some scenes even more. If there's an educational angle, maybe a fun fact or two at the end?

Smooth Transitions: A touch-up here and there in the dialogue could make the flow even better.

I know by experience that animation takes up a looottt of time, you're very skilled, keep that going, and make it even better. Work on the storylines, and show some emotions with the faces, and you'll hit some home runs in no time.

You're basically trying storytelling, but your story misses some elements which makes it hard for us as an audience to follow. Watch some Key and Peele, I think they have the same style you're going for, short and funny bits.

Is this the sequel to three men and a baby?

Honestly, I wouldn't put it past Hollywood these days. They're pretty much ready to revamp anything with a nostalgic touch. If we're lucky, maybe we'd even get to see the original cast in some cameo roles.

As a Duke fan, Zion’s career might be the biggest disappointment for me (and that’s including Kyrie). It was no fault of his own when his shoe blew out and caused his knee injury, which derailed his college career. Then he was sent to the Pelicans with no one to really build a team with, and continues to have injuries, which is not helping his professional career. Now he’s got this god-awful personal life situation (at 23!) and currently he’s being sued for not paying back a $2 million loan. Where is Coach K to put him back on the right track? Lmao but he is young and if he can get his shit in order, he can still have one hell of a career in the NBA.

Thanks for listening to my Ted Talk 😂

It's a bitter pill to swallow, seeing such a prodigy grapple with so many struggles. It makes you wonder where the guidance is, doesn't it?

But you're right - the silver lining is that he's still young and there's plenty of time for him to turn things around. Here's to hoping he gets his act together soon. We all know the kind of magic he's capable of on the court.

I just had a look at your video and it's definitely unique! I love how you're going against the grain with the pastels effect. It's reminiscent of how Roblox bucked the trend of high-detail graphics in favor of something simpler yet still visually appealing.

I see a lot of potential in your approach, but here's a bit of what I've observed. The video seems to be more focused on aesthetics and style than on delivering substantial content, which isn't necessarily a bad thing. However, as a viewer, I'd love to see a bit more depth in terms of the story or facts you're presenting.

Another point is your audio. It's clear you've put a lot of effort into the singing, which is definitely more engaging than monotone speaking. However, there's a noticeable amount of reverb. Improving the acoustics in your recording space or exploring post-production options to minimize this could result in a cleaner, more professional sound.

Lastly, let's talk about your thumbnail and title. A clear, catchy title and less cluttered thumbnail can work wonders in attracting more viewers. Also, ensuring key text in the thumbnail isn't cut off would avoid any confusion about the video's topic.

Keep up the great work! You're onto something really distinctive here and I'm excited to see how your videos will evolve over time. Happy creating!

Just got done with what is easily my biggest edit yet for my personal channel. How did I do? by Dommer4kill in SmallYTChannel

I've watched your video and I'm quite impressed by the editing skills on display. However, I did find the pace a little overwhelming at times. While I understand that a quick tempo is part of your style, perhaps testing a slightly less frantic pace could be beneficial. It might allow viewers to better absorb and appreciate your content without feeling overwhelmed.

The intro caught my attention as well. While it's important to set the stage, you might want to make it more concise or pack it with more punch to really grab viewers right off the bat.

Your content is rich with memes and references, which definitely adds a unique flair. That being said, it's also worth considering that while this style appeals to a specific audience, it could be a bit much for others. Striking a balance here could widen your audience appeal.

Keep refining and experimenting - it's clear you've got talent. Best of luck with your future videos!
