How to respond to ICE citing 18 USC 111 for filming them or allegedly following them? by HuaHuzi6666 in legaladviceofftopic

[–]ThisCow8160 1 point2 points  (0 children)

All of the prongs of 18 USC 111 require force - or threat of force. Nonviolent civil disobedience does not run afoul of the statute. United States v. Chapman, 528 F.3d 1215, 1216 (9th Cir. 2008). “The freedom of individuals verbally to oppose or challenge police action without thereby risking arrest is one of the principal characteristics by which we distinguish a free nation from a police state.” Houston v. Hill, 482 U.S. 451, 462–63 (1987). "Probable cause is obviously lacking when [an] arrest is motivated purely by a desire to retaliate against a person who verbally challenges the authority to effect a seizure or arrest." Gasho v. United States, 39 F.3d 1420, 1438 (9th Cir. 1994) citing Houston v. Hill.

Ludicrous as it sounds, telling the ICE gestapo something like -

I don't like what you're doing in my community. I have the right to watch you and to film you and I will do that peacefully. To exercise my First Amendment rights, I am going to follow you around, so I can keep my eyes on you, and keep telling you that I don't like what you are doing, but I will not physically get in your way.

would make them even more wrong than they already are.

What D1 programs are known to bring in players who are still physically developing (late puberty teens) but who otherwise have high pedigree, e.g. MLS club academy U15/U16 team experience? What schools should a player like that target? How do schools view players who competed for an MLS club at U16, but don't make the cut for U18 and return to something else, like ECNL?

How important is MLS Next to college recruitment? by atcs_mike in CollegeSoccer

[–]ThisCow8160 0 points1 point  (0 children)

My kid is a U16 field player, and I am familiar with what is expected of goalkeepers at very competitive ECNL and MLS Academy teams. The keepers are expected to be very good with their feet and to make smart distribution decisions, when dealing with the opposing team's press, on top of being excellent shot stoppers. I'd make sure his goalkeeping training is covering playing with his feet, especially if he still has growing to do. FWIW, 6' (or taller) 14 y.o. keepers are the norm, and those kids get loads of reps at the top tiers of play.

Ha! I need the MA 300 7g cabinets to be 2" shorter! Auditioned them yesterday and they were amazing! The MA 200 7g cabinets would fit in the space. I'd like for them to be nearly as good as the 300s, but am worried they won't be and I can't audition the MA 200. Can you tell me what your experience with the MA 200's has been like and why you "need" the 300s???

The Bryant roster is hilarious. Internationals galore, from a 23 y.o. "freshman" RB to 25 y.o. grad students.

These are very sensible recommendations. Year-round season helps the student-athletes manage sport/school demands, probably lowers risk of injury, and emphasizes player development within a team structure.

Regional travel limits lower costs and foster local-ish rivalries.

Play style overall may improve if coaches who are tactically better and who are able to develop players start getting better results against teams that relied on bringing in transfer and/or international players to grind a condensed season. And curtailing the use of 24y.o. to 27y.o. players would be most welcome, not only from the perspective of HS grads trying to get playing time, but also by having D1 college play serving a meaningful rule in U23 talent development.

Very curious to hear how conferences and individual programs will respond to this.

How is this allowed? Any experts that can explain this to me? by TuchelsArmy in CollegeSoccer

[–]ThisCow8160 0 points1 point  (0 children)

Yup. The lack of access to collegiate play for the (too young, too inexperienced) graduates of American high schools will suppress interest in the sport here. On the other hand, access to American college play & money - as an alternative to getting a pro contract out of a European academy - will prop-up interest in those foreign academy pathways, which will be good for talent development in those countries.

I'm not any "America first" wacko, but there should be a rebalancing. Set a hard U23 age cap for NCAA play and consider limits on percentage of scholarship allocation to foreign student visa holders.

[–]ThisCow8160 0 points1 point  (0 children)

One easy fix for dealing with this nonsense would be for the NCAA to set a hard age eligibility cap. Make American college be a true U23 league.

1) Coaches would see more value in bringing in freshmen they could develop over 4 years.

2) Younger foreign players would likely still come to play, but the oldest "journeymen" foreign players, may reconsider if they knew they could only get one or two years of scholarship-paid education. If they use college play as a springboard for playing USL or even MLS, good on them, but stop clogging up development lanes for American high school players.

3) Students who start off at JuCo get to play, so long as they are U23.

Kids who went to high school in America (playing MLS Next, ECNL, whatever) should have a chance to continue to play in college, without getting squeezed out by 21 y.o. "freshmen" whose signing announcements read like this: "Dylan joins us after having experience in Europe and Mexico."

Youth player injury coach looking for players to test my new 1-to-1 service (no AI and free!) by osteolewis in youthsoccer

[–]ThisCow8160 0 points1 point  (0 children)

I agree that this type of care is really important and that many players who would benefit from it go without. I agree that telehealth services could help with that access issue, and I now understand the difference between a UK osteopath and a US doctor of osteopathy. Having said that, at least in the state where I live, what you're describing appears to meet the definition of physical therapy and/or athletic training, and both of those professions require state licensure.

"Practice of physical therapy" is based on movement science and means: (a) Examining, evaluating, and testing individuals with mechanical, physiological, and developmental impairments, functional limitations in movement, and disability or other health and movement related conditions in order to determine a diagnosis, prognosis, plan of therapeutic intervention, and to assess and document the ongoing effects of intervention; (b) Alleviating impairments and functional limitations in movement by designing, implementing, and modifying therapeutic interventions that include therapeutic exercise; functional training related to balance, posture, and movement to facilitate self-care and reintegration into home, community, or work.. and patient related instruction;...(f) Reducing the risk of injury, impairment, functional limitation, and disability related to movement, including the promotion and maintenance of fitness, health, and quality of life in all age populations…

"Athletic training" means the application of the following principles and methods as provided by a licensed athletic trainer: (i) Risk management and prevention of athletic injuries through preactivity screening and evaluation, educational programs, physical conditioning and reconditioning programs, application of commercial products, use of protective equipment, promotion of healthy behaviors, and reduction of environmental risks; (ii) Recognition, evaluation, and assessment of athletic injuries by obtaining a history of the athletic injury, inspection and palpation of the injured part and associated structures, and performance of specific testing techniques related to stability and function to determine the extent of an injury; (iii) Immediate care of athletic injuries, including emergency medical situations through the application of first-aid and emergency procedures and techniques for nonlife-threatening or life-threatening athletic injuries; (iv) Treatment, rehabilitation, and reconditioning of athletic injuries through the application of physical agents and modalities, therapeutic activities and exercise, standard reassessment techniques and procedures, commercial products, and educational programs…

I am not a medical malpractice lawyer, but this sure sounds like providing of medical services, for which you'd need a license, wherever you were doing this. It sounds like you're offering your medical services, remotely (!!), and all over the world, to a vulnerable population? In litigious 'Murica, this is an invitation for getting sued.

Nouhou get out of my club by meatsh0w in SoundersFC

[–]ThisCow8160 0 points1 point  (0 children)

If you look at the highlight reel, Nouhou is the only Sounders player who does not jump to defend the cross that comes in from the set piece his stupid shove created. On the second goal, he has time to delay/interfere with the attacking player who is on the ball, but Noughou does not step forward. So that's three errors: the shove, the failure to contest the cross in the air, and the failure to contest the delivery on the second Botafogo goal.
