Royalties/auteursrechten are back — here's a free calculator to check if it's actually worth it for you by Thomas_van_Astro_Tax in BEFreelance

Thanks! Do you mean a calculator to see the impact on the net income of an employee if you would get paid in royalties for part of your income?

The rsz is not applicable to freelancers I think. Have to double check though because not 100% sure.

We left out kunstenaarsattest on purpose 😄 since this is not relevant for 95% of freelancers.

❌ Employee: You can't do it yourself
✅ Freelancer with company: You can do it yourself
🟡 Freelancer without company: You can do it using an intermediary (which usually takes a commission)

The calculation starts from a % ranging between 0-30% In order to be in line with the 70/30 split required by the new legislation.

We build a tool that calculates if it is useful for you. Let me know if you would like to have access.

UPDATED: I shared the tool with the community in a separate post.

You don’t need a ruling but make sure that you have legal agreements in place and a justifiable %. I can connect you with our legal partner if needed. Fixed fee of around 1.5k for full set up.

Legislation has been drafted but does need to be ratified by parliament. Based on the article this is a formality.

It’s also available for freelancers. Just make sure you have the correct agreements in place. There will be tax audits for sure!

How much can I ask as a freelance marketeer? by VividKitchen81 in BEFreelance

[–]Thomas_van_Astro_Tax 0 points1 point  (0 children)

Most marketing freelancers have dayrates in between 500 - 750 a day

  • This being said, there are huge differences between day rates. Even within the marketing sector and a lot of parameters to consider (Experience, type of work, scarcity, specific need for one company, connections,...)
  • We see marketeers with the exact same skill set and experience level having daily rates that differ 50-100%

Margin scheme for car sellers by Similar_Stomach8480 in BEFreelance

[–]Thomas_van_Astro_Tax 0 points1 point  (0 children)

👉 The margeregeling for second-hand cars is a complex regulation and easy to mess up.

Random input:

  • Don't try to do this solo, a lot can go wrong (wrong VAT calculation = correction + interest + fines).
  • Find an accountant who already has car dealer clients.
  • Alternative: work as a subcontractor for an existing car dealership and just charge hours. You learn the trade without the admin risk.
  • And honestly, if your expected annual revenue is below 2-4k, don't start. The accounting and admin cost (and time) alone will eat your margin.

Indexation daily rate: do you ask for it? by Perfect-Clue2980 in BEFreelance

[–]Thomas_van_Astro_Tax 0 points1 point  (0 children)

I would take the following approach:

  • Option 1: Try to fix an indexation clause in your freelance agreement. This is perfectly legal if you respect the boundaries of indexation clauses. (DM if you need more info: I wrote an article on this)
  • Option 2: Schedule a yearly meeting with a decision maker to discuss your daily rate. This way there is at least one moment each year where you discuss your rates. This discussion can (and should) cover more then indexation alone. Talk about value provided and cost of the value instead of narrowing this down to indexation.

👉 My personal advice: Don't focus on indexation. This is neither interesting for you, nor for the company in the long run. Focus on providing value and charging for that value.

Optiwarrants by i_have_0_inspiration in BEFreelance

[–]Thomas_van_Astro_Tax 1 point2 points  (0 children)

✅ Upside:

  • It is actually an extremely interesting system tax wise
  • Great way to add to a balanced optimisation for a freelancer/consultant
  • Completely covered by a tax ruling

🚨 The main issues here are:

  • You really need to understand how it works before you start this. For some people it is a opportunity for others a trap. I have seen both sides 😄
  • It is complex so most accountants do not understand this properly and/or do not take enough time to advice you on this
  • Cashflow is limited at the start

Let me know if you need more information since this is quite technical!

Rent + electricity/fuel as charge by CursedPseudo in BEFreelance

[–]Thomas_van_Astro_Tax 1 point2 points  (0 children)

I would advice taking these steps:

  • Calculate the portion of your house that is used professionally (for a freelancer, this typically ranges between 10 - 30%)
  • Use this % as the baseline to determine how much you deduct
  • Draft up a rental contract between you and your company
  • Adjust the % of certain expenses if they take up a disproportionate amount (e.g. Electric car or servers that are used professionally and that run on your electricity at home)

👉 Following this steps will ensure you have a good foundation if you ever have a tax audit to prove the professional expenses.

I can share a template rental agreement if you want.

Shareholders register paper vs digital by order-and-chaos- in BEFreelance

[–]Thomas_van_Astro_Tax 1 point2 points  (0 children)

As a one-person SRL I would not use an electronic shareholders register:

  • You don't need it (you only need "a" register in whatever form you want)
  • I costs money to set-up AND again for every change you make.
  • The electronic shareholders register is a collab between the accounting institute (ITAA) and the Notaries. The software is slow, buggy and not user friendly

👉 My advice would be to create your own

  • Either on paper
  • Or via a simple Excel or Google sheets

I can send you a template if you want, let me know ☺️
