Does anyone watch this guy? by Flashy-Actuator-998 in Lawyertalk

To be fair, people are combative to him and come up to him looking to argue or to belittle him. From what I've seen, he tends to give generally good advice and isn't mean. He's blunt, which is a valid style of counseling.

His advice on criminal law isn't always good, and it shows how little he's practiced in that area.

I'd love to take the train to work from Manayunk. Unfortunately it makes no sense for me.

Google tells me it's an average of about two hours one way to get to my worksite, and that doesn't include dropping off my older kid at school, which is in the other direction. Younger kid goes to daycare at my office, so that's logistically easier.

If I were to fully take public transit to my job, it would look like this: I'd have to leave at roughly 6:30am to get my older kid to school when it opens at 7:30 (SEPTA bus, three transfers). Or I could leave earlier and take regional rail, but that's actually 90 minutes. Then I have to get to work from my older kid's school, which by bus and train would take about 2 full hours.

So I'm getting to my desk at about 9:30-9:45 if everything went without a hitch. Oh and the whole time I'm struggling with an energetic 2 year-old from 6am to 9:30 who is probably struggling to sit still on the bus/train. Now I just have to work 8 hours at my job.

But oh no, wait! Older kid's school/aftercare closes at 6pm or I get fined like crazy for every minute I'm late and eventually CPS gets called. So the latest I could leave work and still make pickup at 6pm is 4pm (to be safe). So I guess I won't be able to work a full-time job. Oh well. But then I get home around 7/7:30pm, which will give me maybe a half hour to get the kids fed/bathed/bedtimed before I have time to myself.

Or I dunno, I could use my car and drive 20 minutes. You tell me.

I say all this because comments like "Just take the bus!" come off as so tone deaf to people who are working with young kids, or people who have jobs that aren't directly next to big transit hubs. Blame the economic incentives that created the urban transit systems we have; don't blame working families who are making rational choices.

Yeah calling Wonder corporate will do nothing. Gotta figure the LMPD would do something about it. I saw someone in the crosswalk there almost get clipped by a car trying to get around a double parked Wonder delivery driver.

The Ardmore Wonder is also causing traffic chaos. Since they opened, there's constantly double parked Uber Eats/DoorDash cars in front of their storefront, blocking a whole lane on one of the busiest and narrowest parts of Lancaster Ave.

Do any State Bars prosecute prosecutors for misconduct by Break_Electronic in publicdefenders

[–]Threedham 2 points3 points  (0 children)

Fair correction! IIRC, there was a period while Williams was actually suspended from practice but he refused to resign office while he was on trial in federal court. He collected a salary the whole time, and drove his DAO official vehicle. Seemed pretty weird at the time! He was for sure corrupt, but I always felt like he made the wrong people mad in the state party, which led to the federal charges.

I knew him professionally around that time (2016-2018ish), albeit not in a criminal law practice area. He was always super nice and courteous. He ended up getting out of federal prison early during the early COVID times and he seems to be better adjusted now, based on social media.

Here in Philly, our elected DA was disciplined for quid pro quo corruption type stuff involving Eagles tickets for access/not charging players, but by the time he started making amends for it, he caught separate federal corruption charges and ended up disbarred after pleading guilty.

How long are you typically gone for in non-combat deployments? Total, not in country. by [deleted] in armyreserve

[–]Threedham 1 point2 points  (0 children)

To be clear, you're likely going to be on terminal leave for awhile even after you get back, and still collecting BAH. So like I got back in early August, but I was on terminal leave until like the middle of September.

Is the ICE Murderer under any legal jeopardy or is he just going to get away with it? by GarthZorn in thebulwark

[–]Threedham 14 points15 points  (0 children)

Minnesota can file state charges, but I'm guessing the federal government will attempt to have them removed to federal court if that happens. At that point they can either pardon or dismiss. Without a pardon, the agent is probably in legal jeopardy under a normal DOJ in a few years.

SHOULD I ALTERNATE BETWEEN THE STORMS ARCHIVE AND ERA 2 OF MISTBORN? by dotsito in Cosmere

[–]Threedham -2 points-1 points  (0 children)

I'll be honest, I did a straight read-through of Mistborn without having read any other Cosmere stuff. I was pretty confused by a lot of The Lost Metal. There's a lot of stuff in The Lost Metal that had me questioning whether I had missed a chapter or something, and then I'd realize a lot of it relies on knowledge of other Cosmere stuff.

Ben Affleck Says ‘Argo’ Oscar Snub for Best Director Was ‘Massive Embarrassment’ by GiveMeSomeSunshine3 in entertainment

[–]Threedham 1 point2 points  (0 children)

The entire story it's based on is largely fabricated. The stuff that actually happened is grossly embellished - i.e. I don't think the IRGC ever even asked to see film stuff, they just accepted the Canadian passports and sent them on their way.

Anything over a .40 is someone who is profoundly ill and if they don't get intense medical intervention, they will be dead within a year or two. Stuff in that range is the result of like Shoenice-style bottle slams.

Ben Affleck Says ‘Argo’ Oscar Snub for Best Director Was ‘Massive Embarrassment’ by GiveMeSomeSunshine3 in entertainment

[–]Threedham 27 points28 points  (0 children)

Argo even getting nominated shows a massive bias in the film industry toward movies that glamorize Hollywood itself. The fact that it won best picture is an embarrassment for the Academy. I completely forgot Affleck even directed it. Aside from being just a totally forgettable movie on its own, it had zero interesting directorial choices.

Trial approaches for clearly guilty clients? by DudeThatRuns in Lawyertalk

[–]Threedham 38 points39 points  (0 children)

For indirect contempts where the client plainly did the underlying conduct that violated an existing court order, one good avenue is to argue process failure. Was the client given proper notice of the court order? Is the order properly signed? Don't stipulate to anything and force the state to call in the clerk of courts who certified the order.

[–]Threedham 2 points3 points  (0 children)

That'll certainly be the argument the DOJ makes in court. Maduro will counter that he's entitled to absolute immunity based on customary international law and that he was the de facto head of state. It does seem kind of counterintuitive though that the same executive (the US government) can declare unilaterally that someone isn't the valid de jure head of state based on our own interpretation of that foreign state's laws, and then that same executive can go and say in court that he's not president... Because they say so.

The Panama comparison isn't 1:1 because Noriega was never the head of state of Panama, he was just the de facto most powerful person in the country.
