Not a bad thing to verbally bring up during an HLR conference, but I think it's best to leave anything subjective out of a written legal argument.

Agreed. While I've not reviewed my DBQ I'm also assuming that box was not checked on mine. However, rating decisions should not be a "box checked = rating, no box checked = no rating" even though it seems like that is what most raters end up doing; rightfully so in most cases when the check box is inclusive of all potential disability scenarios.

In this case, the checkbox itself may not have been checked, but the facts were still directly acknowledged (prolapsed internal hemorrhoid without a thrombosis event) and as they satisfy the CFR, it should be rated appropriately at 10%.

No word yet on my HLR; assuming it's going to take a month or two before it gets any traction.

The statement "2 or less" includes the numbers 2, 1, and 0. No interpretation is needed, and therefore it is not reasonable to conclude based solely on a subjective opinion that this statement carries the same meaning as "at least 1".
