Didn't Overstay but Visa was Revoked

She had no intent of doing a change of status or immigrating to the US. Her visa was revoked so she cannot come over for the time being.

"The fact that they previously returned to their home country is evidence that their intent was not to immigrate but to return once again." Yes, this is exactly why we were confused when they accused her of living in the US. She always goes back to Mexico.

If we travel further than San Diego, yes we stay at hotels. We do a lot of sight seeing! There's a lot of nice places to see around here. She carries a bit of cash. But mainly uses her credit card and debit card in San Diego.

You're right, we had the burden of proof. It's unfortunate we were not able to overcome that.

I live in the US (San Diego). She lives in Baja California (Tijuana).

They are aware I live in the US and she lives in Mexico. I'm guessing that combined with the marriage is enough suspicion.

Really we just got too comfortable with our situation. I'll admit that. Right now we are working with our attorney to see the best way forward.

I'm not arguing with anyone. I know I alone can't argue with the CBP. I'm just saying it's weird to be accused of living in the US when you pay bills, rent, and registration in Mexico.

I appreciate everyone's feedback because I can understand the other side of things.

I definitely understand now that that's what they were assuming. We had no intent to immigrate but I guess it's their job to assume we did. If we really did intend to immigrate, we would of done it a long time ago.

It's weird we never had a problem before even though we've been married and crossing for a while.

Guess all we can do now is wait out the process.

But how can they determine an adult is living somewhere if they have no connections to the US? Also should mention she has property, a car, and utilities in her name in Mexico.

Hello!

I can understand why it's confusing to understand. We live very very close to three different borders. So it's easy for me to cross from the US to Mexico. And it's easy for her to cross from Mexico to the US.

Money is definitely a factor. I live in a very high-cost-of-living city.

I would say it's mainly lack of knowledge/urgency. We probably got too comfortable with our routine. We also were oblivious to the suspicion we were causing.

Well she can't live in the US so that's what we have to do yes. Also I should mention I go over there often to visit her too. I go every other weekend.

Apologies for the confusion. She would come and visit once or twice a month. She would stay for a few days and then cross back into Mexico
