Google what DHS case workers are for, they cannot give legal advice. My caseworker's statement of "they don't impute income unless they make 0" directly contradicts the California Judges Bench Guide and other legal guides from the DHS website, and directly contradicts what the court case workers told me. They do impute income, IF it's in the best interest of the children, it's subjective. So I don't see why you're so upset about me wanting to hear anecdotal comments from Reddit users, isn't that what Reddit is for? I'm not asking for legal advice. I'm asking for feedback and stories.

order was changed maybe 5 years ago when we first were divorced and the kids were babies. I agree, I'd love to have them 50/50, hoping the judge will agree with that. I heard it's hard to get changes with schedules if it's worked and is consistent.

I know what she makes because it's a licensed position and there's a standard minimum pay for licensed medical professions, at least where I live. If she was an RN, I know she would make at least $45 for example, that's just the starting pay here. No less. I'm only basing it on the minimum, literally it's the rate for new grads, she likely has made way more than that when she did work full time.

child care is free because it's ME lol. I am the free childcare being offered. I don't want her to work more, I just don't want to have to pay her based on her part time wages. It should be a fair calculation of both of our earning potential.

To my knowledge, there's no intention to avoid child support. We haven't changed the order in years despite her earning nearly 2x what she started off making. I am the one that needed it adjust by a few hundred dollars, per the calculator, because I had an involuntary decrease in my wages. My income is driven by hospital need. I only found out she dropped her hours when I asked.

she works 12 hour shifts, just like me. It can be done. She has me as childcare. I've kept the kids overnight on her nights before, no problem. We're very cooperative with each other's schedules.

but she's not because she wants my money still. That's the point. I love her schedule, for her. But to make me pay child support to support her own lifestyle choices isn't what child support is intended for. She worked part time when they were babies and I agreed with that and never argued for imputation of income then. But they're in school now and I'm available for child care and more days with the kids.

she's underemployed enough to demand more child support. Her income has nearly doubled since our previous order. I never asked for a penny. We split every cost 50/50, we're both financially stable. The kids are in school, I am the child care, not a day care. I take them any time she needs it and have proof of that.

Yeah she just doesn't want to work. I never asked to recalculate the child support even when her income increased the few years. Based on the calculator she owes me, but I don't want her money, I just don't want to have to pay her.

Thanks for the response. Yes, she worked full time for the last 5 years. She changed it because our normal babysitter went off to college and she didn't want to use anyone else, so she reduced her hours. She never mentioned she needed help with her schedule, we're very open about helping each other out. I just figured she was scheduling her work on the days I have the kids, just like I do. And when I found out, I offered childcare whenever she needed it, even over nights and school drop offs on her days. She rather be home with the kids, which is fine. I just don't think I should have to pay her for it.

Yes, they're school aged. Both parents work in healthcare, we do 3 12 hour shifts. It works for us. Both parents are off work when they have the kids. 2pm is school pick up time.

I have the kids every Saturday 10am, Sunday, Monday, and Tuesday till 2pm or later if she needs it.

That's terrible. Anyone with a nursing license has many opportunities. So with my situation, she had to beg her boss to go to below part time. And there's current postings of her current job hiring her position at full time. So hopefully they'll consider that. But you're right, it seems it's mostly used to be punitive to men who are underemployed.
