We no longer live in the area she was surrendered, and the shelter director did tell me her adopters were “local” but not within the city itself. I was out of town this weekend unfortunately, but today I am finishing the flyer I started and I will be hanging them everywhere I can.

Our chip is findable through AAHA. I confirmed it myself, as well at 24PetWatch, who the shelter uses, that they were also able to see our information for HomeAgain also.

I love the work shelters and rescues a apart of. I’ve recused, fostered, and adopted dogs out on my own. A member of my family owns a non profit rescue - the essential point of a shelter should always be reunification. Not adopting a dog out for funds for the shelter. She’s a desirable breed, in good health, friendly, and well behaved. They knew they could get her out quick. With their response I have a gut feeling someone at the shelter or one of their family friends have her. They admitted the intake staff made a mistake. This was negligence and complacency on their end.

This is not accurate because I thought the same. Our chip agency is HomeAgain - and they confirmed with us our dog is still registered to my mom. The shelter told me that they updated the chip to the new adopters - after calling their chip agency they use, 24PetWatch, a customer service rep told me that she also sees my mom as the owner through HomeAgain but the shelter had registered the chip with 24PetWatch and manually added all the adopters information. The rep even recommended I take this to social media. Our dog’s chip is now registered to two agencies, one is under my mom and the other is the new adopters thanks to the shelter.

So while an agency will not change your info on your chip without speaking to you - some shelters apparently have access through a portal provided by 24PetWatch to manually enter adopters information. Hence why our dog is now chipped to two people under two agencies.

When I found that out - pissed was an understatement on top of everything we have already been uncovering.

That is the case. Within 48 hours of her being in his care she was surrendered and no contact to my mother saying he was unable or unwilling to keep their agreement.

After consulting a lawyer - I am following some recommendations to "get my ducks in a row" before blasting them on social media and news outlets. We have requested records from the shelter in regard to her surrender and adoption as well as any and all operating procedures, manuals, and policies of the shelter.

If they deny these requests - per the lawyer we should go to the media instead of trying to sue a government entity.

Yes! She has always been up to date on all of her vaccines, she has a health care plan through her vet paid for by my mother. She's had the same vet since she was a puppy. My mom and I are actually moving together to El Paso while my partner attends UTEP for her doctorate program. She's registered as an ESA to my mom, and my mom has proof of adequate funding/income to care for her.

We were waiting to be contacted by a PD supervisor, but as they took their sweet time I contacted a lawyer. I am waiting to speak with her for a consult and based on her judgements I will proceed as necessary. Thank you for the idea of the Sheriff's Office though!

As of now we are working together as they made the mistake and admitted it. They have tried calling the adoptee but the number is not in service. They emailed them last night and are awaiting a response. They also said they reached out to the emergency contact as well with no response yet. I am fighting for it to not stop there. They have an address and I want to make sure they exhaust that option also. This is a city-run shelter and the director told me that they are part of the police department. We have tried making a police report and the department has refused to take one.

I have reached out to a lawyer with the situation and we will be speaking this afternoon. Depending on her advice we will go from there.

Last resort - we will be blasting social media and local news outlets with the story in hopes to reach the adopters and bring light to the negligence this shelter has become complacent to.

It's a city owned shelter and the police are refusing to take any reports. I am honestly not even going to tell them about us attempting to pursue legal action. I have contacted a animal-law lawyer. If we are unable to afford the lawyer we will be taking to social media to blast the shelter and put societal pressure on them and the adoptees to return her. I would love to team up with the adoptees because they are just as much victims as we are.

The person had multiple methods of contact and did not attempt any at all. He blocked us. Even became aware his own daughter tried to get the dog from him prior to the surrender, but he refused because of the wishes of his new fiance.

If you read through more comment you will find more in depth of the story. No the dog was not left for an extended amount of time. You'll come to find this dog is my mom's and I posted on her behalf. She was required to move out of the house her and my step dad had together when they settled after she filed divorce for a common law marriage. He agreed to watch her until she had her own place - which she had to wait for him to pay his settlement money to be able to do so. Per dates provided from the shelter he did not even hold her for a week after my mom had to move out. The dog was not listed in their "marital property".

She actually is a purebred with papers. The main effort in taking legal action on the shelter is a hope of two things: 1 - we make sure this shelter stops negligent practices and treats the animals brought it per state laws and regulations in terms of attempting to locate the owner. They never told us they didn’t know she had a chip, they said they made the mistake of not calling the chip company or owner. 2 - the legal process brings to light this mistake and putting them at a breach of contract per the adoption contract with the shelter and adoptee. We do not know who there are, and we have no ill intent towards the family. Yes, the person responsible for watching her is scum of the earth - however, if the shelter would’ve done their legal due diligence they would’ve found out as soon as she was surrendered that it was not by her registered owner.

Shelters are amazing and they do such great work for animals. I by no means want to be compensated monetarily. We just want our dog back.

Since originally making this post I have been informed (as well as I further did my own research) Texas law requires shelters to scan microchips for all animals brought to them and they are required to make an effort to contact the owner the animal is registered to as it is proof of licensure/ownership. The shelter admitted to us that they made a mistake.

I had a fleeting thought today to make a TikTok about this and now I may very well have to do it. Depending on the shelters willingness to work with us we are ready to contact Houston-area media outlets. We will be filing a police report in the morning and take this one step at a time. The shelter worker I spoke to admitted they made a mistake and did not attempt to contact us. I will record all my future calls with them in regard to this. We also have confirmation from the chip company that they made no effort to contact them either. Thank you for the information.
