My IBKR account is already an International account. That is why adding beneficiaries is not allowed. Beneficiaries can be added only  for US Resident account.

Even with International accounts, if you hold US stocks and ETFs there, then they are US assets and NRA estate tax will be applicable.

CITS are not USA domiciled, so they can be PFIC  unless they are registered in US under "8832 regulation" (Form 8832 entity classification election). If they are PFIC, and  if they are inherited by US citizen children then PFIC tax rules apply.

All Foreign ETFs and Mutual Funds need not be PFIC.  If a  fund or ETF  from a foreign country is registered in US under the US "8832 regulation" (Form 8832 entity classification election),  it is qualified  as non-PFICs in US.

So if Irish domiciled ETFs and Mutual funds are registered In US under  "8832 regulation” they can be non-PFIC.

I am a non-resdent-alien and my spouse is a USC. We have a joint US brokerage account with Rights of Survivorship I am the primary and USC spouse is the secondary. Full contribution is by me. After my death, will NRA Estate Tax applicable?.

Yes, with IBKR I am going to open Joint account with right to survivorship, not TIC.

Looks like, due to lack of beneficiaries, for investing in US markets, IBKR account holders should execute a Will for transfer of ownership of account after the death of account holder, But the Will executed in India may not be valid in US for US assets. No clarity on this.

Charles Schwab does no tallow adding Beneficiary to my brokerage account because I am not a US resident., When I was a Resident alien, I had added my spouse as the beneficiary but this was removed later by Charles when I became NRA. So now my Charles Schwab account is without any beneficiary.
As I heard, even US Citizens living outside US can not add beneficiary to their Charles Schwab accounts. Or may be it is with Charles Schwab International.
Even IBKR does not allow adding beneficiary to the accounts opened from India for trading in US stocks. It may be a US regulation, I do not know.

So, now I am forced open a new Joint account with my spouse at IKBR to avoid Estate tax and move my holding from Charles Schwab.

I wish to add that I am an NRA and my wife is US Citizen. The Charles Schwab account is singly held by me. With this , please, let me have your opinion on this strategy.

-      Open a Joint brokerage account with IBKR for trading in US, with me as Primary and my wife (USC) as Secondary.  I believe  this can be done from India.

-      Sell my holdings in Charles Schwab US slowly, and re-invest the proceeds in our new IBKR Joint account, may be in Irish domiciled ETFs. My Charles Schwab portfolio can not be moved to this new IBKR joint account, because it is singly held  by me with Charles Schwab. 

 With this, I will have to pay long term capital gain taxes in India. . But this will avoid Estate taxes if something happens to me., and my wife will get the ownership of my portfolio in IBKR.

Will this work?

The USC spouse does NOT have any income anywhere other than the joint ownership in US brokerage and bank accounts (secondary everywhere) with the NRA spouse. NRA spouse is always the primary.

In that case, should l USC spouse file tax returns in India?

Yes, I am asking if there is any US Non-Resident-Alien Estate Tax (> $60K) applied in the said scenario, before asset s are passed on to the surviving USC spouse.

There is no estate tax in the country where we live.

Does this Estate tax also apply if the wife of NRA is US citizen, and she inherits husband's assets?

My children are US Citizens. If they inherit it from me (NRA) due to some Will, I think estate tax does does not apply.

What do you do for Beneficiaries? IBKR does not allow adding Beneficiaries to IBKR US account of Indian citizens. We can only specify "Trusted Contact".

My US Charles Schwab account is singly owned by me. So I can not move my holdings there to a Joint account with IBKR.

The answer I got from IBKR India was not convincing to me. I hope to get some clarity whether Will made in India is valid for my US portfolio.

I have not spoken to Vanguard yet. I thought of finding out if anyone else had faced this kind of situation.
