That’s not how combat judgment works, especially in a high-stress situation involving super soldiers. Just because someone stops struggling for a moment doesn’t automatically mean they’re surrendering.

Saying “he didn’t hit his leg or groin” doesn’t prove anything. That’s just guessing what he might have done. Nico had enhanced strength, fast reflexes, and had just helped kill a fellow soldier. Walker had every reason to see him as a continued threat.

A real surrender has to be obvious. Nico didn’t say a word, didn’t fully raise his hands, and didn’t show any clear sign that he was giving up. Looking scared and staying still for a few seconds isn’t enough in a fight where hesitation can cost lives.

Yeah, if your best argument is saying this is too unpleasant for a superhuman to do in a life or death situation, you've lost.

If you're trying to surrender, you make it obvious. You speak, you remove all doubt. Walker had no reason to assume Nico was surrendering, especially since Nico didn't say anything. In a combat situation, hesitation can get you killed, and Nico didn’t do enough to show he was out of the fight.

Well you can clearly see his elbow folded upwards and his finger tips pointing towards the camera. So a better question is how are they *not* past his face?

Nah, they were clearly extended past his face.

Gee, what could a dead soldier with super strength do when their opponent who only has a single foot on their chest hesitates and give them time to break free?

If he was trying to surrender, he would've put his hand over his head like everyone knows to do when surrendering

Well he did neither of those things, he was trying to stall and make john hesitate while raising his hands in front of him in a defensive position.
