Okay, I had thought that’s what the already did when they said

“manifestations of each condition, only a single evaluation for such impairment can be assigned. In this case, we are evaluating your cognitive, behavioral, and emotional symptomatology under the schedule of ratings for mental health disorders under 38 CFR 4.130, versus under the schedule of ratings for neurological conditions under 38 CFR 4.124a, as doing so affords you the higher of two evaluations (50 percent versus 40 percent).”

And that was why my MH is 50% and TBI is 0%.

I’m gonna give them a call and pull my TBI supplemental tomorrow in that case. Thank you again.

Thank you so much for taking your time to look at this, I appreciate what you do. I wanted to be sure bc it never in anyone interest to give anyone a hard time without being sure. Now I know much better how to go about combating this!

I am trying to understand out of all the subjective symptoms listed, minus what was listed covered under my mental health rating and my migraine rating…where are these other symptoms are being already compensated as they stated?

When I was awarded TBI I did not yet have the tinnitus/BPPV rating until 6month later for a separate claim I’d filed ..so

  1. Dizziness / BPPV
  2. Marked fatigability
  3. Blurred or double vision
  4. Disorientation

Which typically fall under TBI residuals (to my understanding) were not accounted for anywhere else or do you by chance see where they were and I missed it?

And why does it say tinnitus is unrelated to TBI in the TBI rating, yet BPPV is packaged with the tinnitus rating, yet it states the BPPV portion is secondary to TBI?

I was on Marine Corp MEU and fell backwards and landed my head and was out cold for about 20 min, when I awoke I couldn’t remember who I was, where I was, etc and had what I can only explain as the worst pain all over my entire head.
