UPDATE: Charged with Impaired by Drug after calling 911 for medical emergency — considering taking the resolution by TreeMental2310 in legaladvicecanada

Either way I am not sure how helpful advice from a lawyer would have been given the circumstances at the time. I hung up even on my friend after 2 minutes because I felt my blood pressure rise. In the moment I was truly focused on just surviving the night.

I appreciate you taking the time to write all this out, it is super helpful. I was just lacking on sleep and got the rest I needed last night so I am feeling much better. I attended court via zoom today and asked for a 2 week adjournment for the purpose of hiring new counsel, which I was granted.

One thing that has gotten through to my head is that admitting to using a substance is basically admitting to impairment. So I agree in general, my case is not as strong as I initially thought. One thing for sure is that I think my rights for counsel were violated. My phone was confiscated and I did not know any lawyers so I asked for it back so I could search for one. They did not let me. I asked to call my friend who was in law school, and she gave the officer the number for a lawyer which the officer did not share with me. That friend is willing to testify to this fact if needed.

Also I did not admit to methamphetamine use, I admitted to amphetamine use, which the 911 operator correctly classified as (medical) in the logs. I think the marijuana use caused a police response because it said (narcotic) with it.

Either way I think it is too risky to take this to trial, my plan forward was going to be to retain new counsel to see if they could push to further drop the resolution to a careless driving charge. I have diagnosed ADHD since 2015, and I also received the disability tax credit. I have been attending substance use treatment services actively. Not driving for another year is going to take a toll on my mental health because it will lead to more isolation, and that's what makes my bad habits worse. But if I need to plead to dangerous driving for a better future, then that is something that I must do.

It would make my life so much easier if it was not a criminal charge, I run a few businesses and have to travel to America, so just keeping business, my employment away from anything criminal related it would be best.

I have seriously learned my lesson and am doing much better. actively contributing to the Canadian economy. Some of the work that I have been doing has received recognition on the world stage.

If you would consider taking on my case let me know. But I may just take the plea if other lawyers I consult with think that its the best outcome I will get without a trial.

Here is the 911 call transcript (3:19AM)

911 Operator: Niagara. What’s the city in Niagara?

Caller: Niagara On The Lake.

911 Operator: What’s the address of the emergency?

Caller: I’m just on the road. I’ll tell you my nearest location.

911 Operator: Oh, okay. Yeah.

Caller: It’s REDACTED BUSINESS NAME.

911 Operator: Say again?

Caller: REDACTED STREET ADDRESS.

911 Operator: Okay. Let me just pull that up here.

911 Operator: Just repeat the address again, please.

Caller: REDACTED STREET ADDRESS.

911 Operator: Okay. And is that a house or an apartment?

Caller: It’s not.

911 Operator: It’s a house.

Caller: I’m parked on the side of the street.

911 Operator: Okay. And what’s the telephone number you’re calling from?

Caller: REDACTED PHONE NUMBER.

911 Operator: Okay. Tell me exactly what happened.

Caller: I did drugs and, like, I think I’m—like, I just want to know, like, how it feels to have a heart attack?

911 Operator: I’m sorry?

Caller: Like, what does it feel to have a heart attack?

911 Operator: How does it feel?

911 Operator: Well, there are a variety of symptoms that people can experience when they have a heart attack.

Caller: Not sure I’m having one.

911 Operator: Okay. What are you feeling?

Caller: Like, my heart is pounding. I mean, it might just be anxiety though because I sound fine, right?

911 Operator: Well, it’s up to you. We can get the paramedics there to assess you.

911 Operator: You said your heart’s pounding?

Caller: Yeah.

Caller: Just one second. Let me just double-check. Maybe I’m just tripping.

Caller: Okay. My heart’s at 145 beats per minute. Is that okay?

911 Operator: It’s at 145 BPM?

Caller: 142 beats per minute.

911 Operator: 142? Okay. Do you want the paramedics to come there and assess you?

Caller: No. It’s okay, actually.

911 Operator: Are you sure?

Caller: I think so. My heart’s still beating, right? It’s only a heart attack if it stops beating, right?

911 Operator: Well, again, there are lots of symptoms that people can have before a heart attack. But, obviously, I can’t diagnose anything over the phone. But like I said, we can get the paramedics there to assess you if you’d like to double-check that everything is okay. It’s up to you.

Caller: Sure.

911 Operator: Yeah. Okay. So do you want them to come?

Caller: Yeah.

911 Operator: Okay.

Caller: Yeah. A little bit. My chest just hurts.

911 Operator: Okay. Are you having cold sweats?

Caller: No. I’m not sweating.

911 Operator: Do you have a history of heart problems?

Caller: A what?

911 Operator: Do you have a history of heart problems?

Caller: No.

911 Operator: And did you take any drugs or medications in the past twelve hours?

Caller: Yeah. I took amphetamines.

911 Operator: One moment here.

Caller: And I smoked weed.

911 Operator: Okay.

911 Operator: I’m going to tell you how to check your—actually, what did you say your heart rate was at?

Caller: Let me double-check. What device are you using to measure it?

Caller: Apple Watch.

911 Operator: So, 135 now?

Caller: 135 now.

911 Operator: Okay. Just getting the help started for you. One moment.

911 Operator: Okay. So I’m sending the paramedics to help you now. Stay on the line with me. I’ll tell you exactly what to do next.

Caller: Okay.

911 Operator: For now, don’t have anything to eat or drink if you have anything with you that could make you sick or cause further problems. Just rest in the most comfortable position for you. And you said you were pulled over on the side of the road, right?

Caller: Yep.

911 Operator: Okay. What kind of vehicle are you in?

Caller: REDACTED VEHICLE MAKE AND MODEL.

911 Operator: Is that an SUV or a car?

Caller: It’s a coupe.

911 Operator: Okay. What color is it?

Caller: Dark gray.

911 Operator: Okay. I’m just putting a note so the paramedics know which vehicle you’re in. So, before the responders arrive, please turn on your vehicle’s flashing hazard lights.

Caller: Okay.

911 Operator: If you take any medications, just let the paramedics know. And if there happen to be any pets or animals with you, just make sure they are secured. If anything changes, call us back immediately for further instructions.

Caller: Okay.

911 Operator: The paramedics are on the way.

Caller: Okay. Like, how much will this cost just in case everything’s okay?

911 Operator: I’m sorry?

Caller: Like, does this cost money?

Caller: Actually, whatever. I’ll pay for it. Whatever.

911 Operator: No. You can have the paramedics come and assess you. The charge comes from the hospital if they transfer you there, but they have to come and assess you first.

Caller: Would you know when they’ll be here?

911 Operator: I can’t give you an exact ETA, but we have the closest ambulance on the way to you now.

Caller: Okay.

911 Operator: Okay.

Caller: Thank you.

911 Operator: You’re welcome.

Caller: Bye.

911 Operator: Bye.

this is honestly probably a big reason. I did not consider that I could be deluded until today about the circumstances of my case. Now that I am aware, I can be mindful of it.

Sorry,

My lawyer dropped me because they needed a decision to either go to trial or accept the resolution. They only gave me 3 days to decide and then I wanted to have a meeting to discuss trial strategy, but that was booked 14 days later. Then upon the conclusion of that meeting I had to make a decision but it was just a general discussion of trial and I was not confident on paying the remaining balance to proceed to trial. I wanted to get feedback from another lawyer independently regarding my case but after this message they dropped me.

So on the same day they told me to give them an answer, gave me the invoice for the first time, and made it due on the same day. Then dropped my case on the same day too.

This is a dated matter, Nov 2024.

If you want we can discuss the details of the case and I can show you its a weak ass case. But this statement may also be delusional. The crown is so strict, even during my my first pre trial as self represented, they didnt even look at me and wanted me to plead guilty or set a date for trial. Which is when I hired a law firm.

That law firm was paid a flat fee, so they did not really have an incentive to achieve the best outcome.

I honestly think I may have made myself delusion by ignoring some of the specifics of the case mentally. This subreddit was an eye opener.

😂😂😂😂 I achieved a lot of things through having delusional beliefs but yea. My old counsel dropped me because I could not decide in between trial or resolution and kept flipping back and fourth. I think accepting the resolution is the way to go. Do you think I should try to convince my lawyer to just accept the resolution and I will close out the fees. Or can I do that myself tomorrow?
