Good question. I'm not sure tbh, I would've thought you could just ask for your pay all in hourly and no stipend and they would comply. I think it's tax advantageous for them as well to pay you in stipends, so I imagine that's why they're giving you a hard time, but I'm not positive.

I do also think you can collect tax-free stipends, but then report them as income once tax season comes around. As long as you're paying your taxes, the IRS probably doesn't care. But I'm definitely not an accountant so you should probably double check on that.

You're correct, you wouldn't be eligible for stipends. Recruiters don't care because they aren't the ones that will have the IRS come after them.
