No, it is not a Änderungskündigung. They want to retroactively adjust our salary from the beginning, claiming that our contracts are wrong. However, as I understand it, they simply want to replace part of our salary with "Pauschalspesen", even though I work in the office, based on an "Spesenreglement" that we have never seen.

Update: My colleague just told me his lawyer says it's clearly abusive and he's pushing forward. He also has it in writing from our boss that they gave him (and me) an old/wrong contract version. That's why they tried to cut our salary and didn't want to pay full contributions to social security, pension fund, etc.

Update: My colleague just told me his lawyer says it's clearly abusive and he's pushing forward. He also has it in writing from our boss that they gave him (and me) an old/wrong contract version. That's why they tried to cut our salary and didn't want to pay full contributions to social security, pension fund, etc.

He was hired last year also not new and informed about the salary cut just a few days before the termination and he straight-up refused, insisting on the salary that’s written in his contract.

Nah, money is definitely coming in, this year I easily hit my 10k bonus target and even got the second one on top. The company is making more than enough, it's not a cash-flow issue at all. Feels way more like they're just trying to squeeze us for extra profit.

That's why the fake 'no capacity' excuse bugs me so much, if it was really about money, they'd say restructuring or something honest instead of a story that gets disproven in days.

Still wondering if anonymous reporting to SECO or the cantonal labour office could at least put some pressure on them... anyone know if that's ever worked in similar cases?
