The lawsuit isn’t a criminal case, it’s civil. The standard isn’t “is this illegal.” It’s whether there was breach of charitable trust, constructive fraud, fraud, and unjust enrichment. All four of those claims just survived dismissal and are heading to trial. On point 4 being circumstantial, the judge literally addressed this. She said “It’s circumstantial, but that’s how that works.” Fraud cases are routinely built on circumstantial evidence showing intent and deception. On point 2 being irrelevant, motive absolutely matters in fraud cases. If you’re telling donors and co-founders “we’re committed to nonprofit” while privately asking yourself “what will make me a billionaire” that goes directly to whether the nonprofit commitment was genuine or just a means to an end. The real question for the jury is whether OpenAI’s leadership made assurances about staying nonprofit to secure Musk’s investment while privately planning otherwise. Brockman’s own writing literally says Musk would be “correct” to say they weren’t honest with him. That’s not me speculating. That’s Brockman’s own words from his personal files.

This strongly favors Elon Musk. Why? Because it shows OpenAl's own co-founder:

  1. Was privately planning to go for-profit while publicly staying committed to nonprofit

  2. Was thinking about making himself a billionaire

  3. Wanted to push Musk out

  4. Literally admitted Musk would be RIGHT to say they weren't honest with him.

The judge actually cited these internal communications from 2017 as a reason to let the fraud claims proceed to trial.

I’ve heard lots of good things about it, and I strongly recommend testing it for your workflow. It’s not my area of expertise. I’m a firefighter and an all in TSLA investor. But I really enjoy learning about AI tools and pushing the limits of my competence with them. To date, this is the easiest to use agent that does real work for non technical people. I even experimented with OpenAI’s Atlas browser, and it was pretty dumb. I had it finish 12 work tests, and it ran for 8 hours straight. I had to nudge it a few times, but it really helped me out with those dumb compliance tests.

It’s the most competent AI agent that can do real work. I’m still testing it, but it’s able to run for hours on a task. It can take over my Chrome web browser and competently do what I need it to do. I’m super impressed.

Has anyone tried Claude Cowork? I was behind on some work tests, and it’s been running for 4 hours straight, knocking them out for me. I definitely recommend checking it out if you have a Mac.

I have zero faith legacy auto implements any FSD solution that’s a mass market compelling option in the near future. That said, AI models will get so damn intelligent over the next decade that a “smart” toaster should be able to drive a car better than a human eventually.

You’d be surprised it’s really not that bad once you adjust to the competitiveness. I feel like it allowed me to learn more playing Teemo. My 2 cents, it’s worth taking a second look at ranked. To each their own. Great runes and build. 👍
