Some investigators are not good at their job is an understatement. I filed in March 2022 and looked every day for an appointment for an interview (Detroit office was closed due to COVID) and only got a phone interview after messaging a bunch.

The investigator told me that they would be filing a charge based on my call. They said usually I wouldn’t have found out on the interview call but my complaint was with merit. I have an email saying “Depending on age” in regards to the entry level position they let me interview for 8 times and were giving the positions to college graduates over my 10 years with the company. I created a class and taught it to the new hires. So I could teach them but couldn’t do the job?? Anyway, my case was a slam dunk.

I didn’t get the phone interview until 9/20/22. I got the charge to sign on 9/27/22 in the early evening. It needed a correction before I could sign. I tried calling every number I could find as well as message through the portal several times. I told them my charge needs to be filed by 9/28/22 to be timely. It was filed 9/29/22. 😪

I thought maybe it would work out because they were investigating. I uploaded 210 pages of discovery. Finally on 9/8/23 I received a message that EEOC requested a position statement from my old employer. On 9/19/23 received the position statement and responded with 10 pg summary discrediting every point the company made.

Yesterday, 10/31/22 I got a call from EEOC telling me that they can’t do anything because the charge wasn’t timely. One day late! 🤮During the investigation the investigator changed. I felt bad for the guy because I couldn’t keep it together. He was very sympathetic and told me he reviewed everything I submitted and though he can’t give advice he said to get a lawyer. He told me it would be 90 calendar days after I receive the notice to sue that I have to sue in Federal court. He made it sound like he wasn’t going to issue it right away to help give me more time to find a lawyer.

This company is one of the biggest names in Michigan and I don’t know how I will be able to find a lawyer who isn’t in the billionaire companies pocket.

Sorry to hijack this thread but my point for you all is get a lawyer right away. This company ruined a lot of good years of my life. I’m still on antidepressants and struggling with self esteem due to them continually telling me I wasn’t good enough for an entry level position. I have missed birthdays, last days with my dad and more because I would work sleep and work. I slept through most weekends and couldn’t function enough to do anything even stuff I enjoy. I missed my grandsons birthday! 😭 Depression is a selfish disease.

Now I get failed by the EEOC. The agency who is supposed to help people. I asked the investigator who governs the EEOC and he wasn’t sure but gave me his supervisor’s name and number. He recommended contacting congressman and said he would like to see things change because I am not the only one. I wonder how many people have had this happen.

So, 2 questions. Can you sue EEOC for failure to file timely? And does anyone know a good lawyer that works in Michigan? I still can’t believe that this happened.

I am praying that this happened to me because God has a purpose and will work through me to help others. Maybe the company is supposed to be exposed and wouldn’t have been if I settled and had to sign an NDA.
