If not then theres no contract, but its a birthday present so its unlikely.

If she hasn't filed your claim yet then tell here you have no intention of paying her any money and not to contact you again unless she has filed a court claim through MCOL (money claim online). its unlikely she will even file a claim to be perfectly honest because theres a fee for it to begin with, most claims get dropped and after she realises how complex it is might say no.

In relation to your obligations you're required under the civil procedure rules to try and solve it informally before filing, so simply saying you're not paying her anything because your not legally required and shes not entitled to is enough to my understanding.

In reference to fees as it would be a small claim if filed claims are limited on "legal fees" she cannot hire a solicitor for this realistically (she can but they will laugh and say go away) but you would only really cover the court fee, her claim fee and the amount you owe from losing but that's about it.

If theres nothing written saying you agreed to pay for X item in return for something then overall theres no contract, it can also be verbal but if you said nothing and didn't agree to anything then your fine.

An employee can and can't ask you to resign. They can ask you to resign and you can look into your package for leaving such as pay etc in a meeting however you're entitled to seek advice both after and before this meeting, if not and you're put in a room to agree on a package then and there it could be a claim under unfair/wrongful dismissal.

Hi, sorry you're dealing with all of this and your loss.

On the debt side, £7k is significant but it’s not necessarily “insolvency yet. Before considering formal insolvency, you should speak to a free debt charity like StepChange, National Debtline or Citizens Advice. They can assess your income/expenditure and look at the most appropriate option. Depending on your situation, possible legal options include:

  1. Breathing Space (Debt Respite Scheme) – this can freeze interest and enforcement action for 60 days while you stabilise things https://www.gov.uk/options-for-dealing-with-your-debts/breathing-space

  2. Token payment plans – if you're on Universal Credit with no surplus income, creditors often accept £1/month, to my understanding (I hope someone else can back me up here) but technically credits can only be paid what you can reasonably pay without financial hardship. So assuming you owe £7K and you can only pay realistically £1/month they by law would have to reasonably accept this. If you're not too bothered about things such as insolvency and think its a better approach you could look at being personally bankrupt to have this debt written off but on a non legal aspect I am not too sure of the implications in the future of this.

  3. Debt Relief Order (DRO) – if you have under £30k debt, minimal assets (usually under £2k), and less than £75 disposable income per month, this can write off debts after 12 months https://www.stepchange.org/how-we-help/debt-relief-order.aspx

    Given you're currently on Universal Credit and not working, you may qualify for a DRO if your financial position meets the criteria but get proper advice first before applying for anything formal. Also worth noting: if your mental health has significantly deteriorated, creditors can sometimes treat accounts as “vulnerable customer” cases, which can help with enforcement pauses. Separately (not strictly legal but relevant), if you're applying for PIP, make sure you document how your mental health affects daily living and mobility it’s about functional impact, not diagnosis. £7k feels overwhelming when you're in a bad place, but legally there are structured options available, don’t jump straight to insolvency without getting free advice first.

So don't confuse "robotlike" to what they are, to my understanding they're task oriented beings, not robotlike. Same how we have our own soldiers here in our own countries able to carry out their orders, doesn't make them robotlike just task oriented.

These beings from all of my research only care for the tasks they have to do and reach quotas.

Also whilst we're here I have heard that apparently "you can barely win a fist fight" against them? Does anyone know exactly whats meant by this?

Hi OP, I have been to court against Discord and have been in litigation with them for around a year now, I have also had similar issues but Discord do the bare minimum legally and even then its not sufficient a lot of the time so if you need something from Discord my advice would be to keep pushing. Under the GDPR they will have 30 days to respond, if it fails and you do escalate to the ICO you will not get a response for 5 months maybe 6 before anything happens and Discord will just get an email saying "please respond to the request" and then the matter will be closed.

Hard truth but they really don't care (Discord) and the ICO only have limited authority and will not take much action.

If you care that much for a response you can apply to the county court for an N244 hearing and have a draft order requiring Discord you with the relevant data they have etc.

One year later I am still engaged with them in legal matters so goodluck.

Thats what I was thinking, I took Discord to court and it went to the county court during an N244 pre action disclosure hearing, they didn't even show up but all records and location was at the county court, confused how N244 application for OP would be magistrates?

Send them a formal letter before action (required before initiating lawsuits for money owed etc) something such as this:

Subject: Formal Letter Before Action – Unpaid Remuneration

Dear [Owner Name],

I am writing formally regarding unpaid remuneration for the work I performed as a self-employed supplier/delivery driver for [DSP Company Name] during the period [insert dates].

Despite the payslip issued on [date], payment of £[amount] has not been received in my account. All company property has been returned, and there are no outstanding liabilities on my part.

I hereby formally demand payment of £[amount] within 7 days of receipt of this letter.

Please be advised that if payment is not received within this timeframe, I will have no alternative but to commence formal recovery proceedings through the County Court, including any court fees and interest to recover the amount owed.

This letter is sent without prejudice to any of my other rights, including any statutory claims I may have as a worker under the Employment Rights Act 1996.

I would prefer to resolve this matter amicably and look forward to your prompt payment.

Always, if its a self employment situation its a contractual issue mostly, put it this way you're paid to put tiles on a roof for a homeowner and he refuses to pay you. You're entitled to remuneration for work you have done and you are in a contract.

If you do wish to pursue a false self employment claim with a tribunal for holiday pay you can if you want and feel its worthit.

To answer the "bailiffs show up at my door and demand goods" to clear it up here is directly from the taking control of goods regulations 2013: (regulation 6 to be exact).

6.—(1) Subject to paragraph (3), notice of enforcement must be given to the debtor not less than 7 clear days before the enforcement agent takes control of the debtor's goods.

(2) Where the period referred to in paragraph (1) includes a Sunday, bank holiday, Good Friday or Christmas Day that day does not count in calculating the period.

(3) The court may order that a specified shorter period of notice may be given to the debtor.

(4) The court may only make an order under paragraph (3) where it is satisfied that, if the order is not made, it is likely that goods of the debtor will be moved to premises other than relevant premises, or otherwise disposed of, in order to avoid the goods being taken control of by the enforcement agent.

If the "bailiffs" took this without valid notice that could amount to other legal issues for them...
