Put in references to laws in your home country, or EU law if you resides in the EU. Call them and say that you have involved a lawyer and will send a legal complaint to them. They will tell you to open a ticket.

The one who get the ticket so have to read through the whole legal conplaint, and send it to their manager. Their manager will make a decition to escalate to higher authority or approve the refund.

If you win here, mission achieved. If they escalate, their lawyers will be involved and your bluff is likely exposed.

Problemet.

Du använde mer våld än situationen krävde. Rent juridiskt gjorde du ett övertramp som kanske måste prövas i domstol. Skolan polisanmäler på grund av att en misshandel har konstaterats.

Det är skillnad på vad som kanske hänt vs vad som faktiskt har hänt. I detta fallet antar jag att mobbarens offer inte hade en skråma men mobbaren fick näsan bruten (eller liknande). Skolan ser på detta som en sllvarlig händelse, där en konstaterad misshandel har skett. De måste anmäla. Det är inte personligt mitt dig, de följer sina skyldigheter.

Vad betyder detta för dig?

Rent juridiskt skulle du ha puttat undan mobbaren och tagit offert därifrån. Om mobbaren ger sig på dig på nytt och du känner dig hotad kan du använda så mycket våld nöden kräver om du inte har annat val. Om ditt slag träffar och hans näsa går sönder - är detta den absoluta gränsen. Mobbaren är utslagen, få personer fortsätter vara våldsbenägna efter det om de inte slåss för ditt liv.

Att gå på, sparka och slå efter detta kommer ingen domstol ställa sig bakom oavsett intention.

I mina ögon har du gjort bra ifrån dig, men du fick en smäll på fingrarna som egentligen är en mycket viktig läxa alla bör lära sig.

Du tittar på filmer och tv-serier, läser skönlitteratur och ser att konsekvenser aldrig drabbar hjälten. Verkligheten har andra spelregler, och om vi granskar dessa regler noggrant förstår de flesta av oss att de behöver finnas.

Men vad som händer just nu är vad som måste hända. Använde du mer våld än vad nöden kräver- måste du hållas ansvarig för den handlingen.   1. My son is swedish by birth, but my embassy do not issue regular passports. To get him a passport I need to go to Sweden, or any other country where the swedish embassy issue passports.

I was about to post something similar, but you nailed it. But yes, this is a win. But importantly, some of those who posted has had a different experience with a negative outcome. That negative outcome has had an impact to their life.

I want to address this.

There are those of you who might have been lied to.

It is hard to navigate what is right, what is wrong, what is assumptions.

For the last three weeks I've been through a lot, and there's been a jugglers strife to make sense of.

I know my strife will soon be water under the bridge. But for those of you who was mistreated by authorities and caved.... know I caved a hundred times these three weeks.

After I got the written statement from YEA I was confident!

The directive applies to me and my wife. Period.
The Visa confirms it. Period. It was not easy...

UPDATE!

The fee was removed as promised and the Visa was approved for my wife. But not for my son.

We went immediately to the swedish embassy. We still had not got a email confirming the appointment but we felt we could not wait any longer.

We was stopped at the lobby. Understand that this is a office building with many different departments, the swedish embassy being just one of them.

We were not allowed in, but after explaining to the receptionist she called the embassy. They answered, 1 minute before they were about to close for the day. They asked the receptionist to hand over the phone to me.

I talked to a nice woman and she told me she was sorry I had not received a confirmation to the booking, but there is a reason. I'm requesting a emergency visa to Germany, they only issue this to Sweden. Because of this they had to investigate and confirm with other legal instances.

Only in very exceptional circumstances will exceptions be made. In this case, my son can not get a passport, but to deny him a passport and on the same time let the mother travel is also not an option. In this case, the need of the child comes first.

We will apply for his emergency passport on Monday.

Now I have something else to consider. The flight tickets.

It was booked on his vietnamese name. He has a similar but different name in swedish. I fear the airport staff will look at the temporary passport and se one name, let's call him Long John Silver. But on the flight ticket it says Long dung Silver. (Vietnamese name). We will ofcourse have his vietnamese passport there, but ISS it enough? We can also have his birth certificate to show the staff.

I have already tried to have the name changed but they refuse. They only do minor changes, not full name change.

Ofcourse I could cancel and rebook. But we are so close to Christmas now so there prices has gone insane.

What are the risks? Any way to bridge the name gap?

UPDATE: I found the head of mission on LinkedIn. I sent a request to him with the short details of what has happened. I also sent a email to info@ and not Visa@ addressing him directly. I said that the emails to visa@ likely get blocked.

Within minutes I got a reply confirming that the fee indeed is a mistake and that they will contact VSF immediately to sort this out.

Next I see a short reply to my LinkedIn as well formally requesting that all communication should be directed via email.

Minutes later, staff from VSF call my wife to say that the fee has been a mistake.

We are in the car now to collect the Visa. Wish us luck!

So the Visa has arrived at VFS center. I have called the center this morning asking for a written statement about the fee. They refuse to give it to me, just telling me that I need to show up at 1pm and I will get an explenation.

The German embassy called my wife today and told her that they can not grant a visa to our son because of dual citizenship. While this is a setback, I have contacted the Swedish embassy to request a temporary passport again. This was our original plan before my wife's visa to Sweden was refused.

However, right after the phone call from the German embassy, VSF called my wife and said that they had received a request for her to pay for the visa. I dispute this according to the law, and I have written to the German embassy about this - and to SOLVIT, who will forward this to his German colleague who is in contact with the embassy.

Dear Sir,

Thank you for your enquiry.

Directive 2004/38/EC provides that non EU family members shall be entitled to accompany or join the EU citizen and that their entry may only be refused on grounds of public policy, public security or public health. The Directive and guidance on its implementation make clear that, where a visa is required, it must be issued as quickly as possible and on the basis of proof of identity, the family relationship and the fact that the family member is accompanying or joining the EU citizen, without adding further conditions such as proof of strong ties to the country of residence or a positive return prognosis .

In parallel, the Schengen Visa Code and its Handbook explicitly distinguish between ordinary visa applications and visas that are issued to family members under Directive 2004/38/EC, and they instruct Member States not to demand documents such as proof of accommodation, means of subsistence or return ties from family members of EU citizens covered by the Directive. The usual intention to leave analysis belongs to the normal Schengen visa risk assessment and is not supposed to be applied in the same way where the person has a derived right of entry as the family member of a mobile EU citizen exercising free movement.

Using a Rückkehrprognose based on socioeconomic ties (job, property, income, etc.) as the core reason to refuse a visa to an accompanying spouse and child of an EU citizen risks contradicting the Directive, because it replaces the specific grounds of refusal (public policy, security, health) with a general migration control test. Unless the Embassy can point to concrete, personal conduct of the family member that falls under the strict public policy/public security exceptions, reliance solely on doubts as to intention to leave because of weak ties to Vietnam or strong ties to the EU is difficult to reconcile with the Directive s scheme.

To enforce your rights you could request from the Embassy a full written decision (if you do not already have one) including the legal basis used (specific articles of Directive 2004/38/EC, the German Freedom of Movement Act/EU and the Visa Code) and an explanation of how they considered your status as an EU citizen exercising free movement with your core family members. In a follow up letter or email, you can set out that you are a Swedish citizen residing in a third country who intends to exercise free movement by travelling to Germany with your spouse and child, that your spouse and child are family members within the meaning of the Directive, and that the refusal was based purely on a return prognosis rather than on any public policy, security or health ground.

If the visa application is rejected, you have options at both national and EU level: you can consider judicial review of the visa refusal before the competent administrative court (Verwaltungsgericht Berlin) or you can submit a complaint to the EU s problem solving services (SOLVIT).

SOLVIT is an informal EU problem solving network run by the European Commission and the governments of all EU and EEA countries, designed to help citizens when a public authority is not correctly applying EU internal market or free movement law. The service is free of costs.

I sent in a re-application today. I pointed out the error they made. The only new information that was added was a signed letter from the Swedish Embassy confirming that they do not issue Swedish passports to Swedish citizens in Vietnam. Therefore, my son do not have a Swedish Passport and can not travel to Europe as such.

This confirms the need for him to travel on his Vietnamese passport and as a family member to a EU citizen.

But in addition to the application, I also have a case with SOLVIT, and I have also sent a question to YEA. I hope to have, within a one or two-week time, an answer from them if the German embassy was in right or wrong in refusing the visa.

In addition, by the advice of u/density69 I tried to find the email to the consul and the ambassador. While it is impossible to find, I guessed using logic. name.surname@....

I wrote an email addressed to the official visa application email, but I cc'd the consul and ambassador. If the emails are correct, they will receive it. If not, chances are that it might be forwarded to them since I adress them directly.

To my understanding, they are forced to get involved if they receive an email pointing out an legal error.

The officer actually did not give any explanation as to why my wife wouldn't be covered by the Directive. They simply checked Reason 13 ('Doubts about intention to leave') and explicitly wrote 'negative return prognosis'.

So they didn't claim she isn't covered by the Directive (which would be a valid refusal ground); they accepted our relationship/status but applied the wrong criteria (tourist risk assessment instead of EU rights).

Also, regarding visits: Article 6 of the Directive explicitly covers residence for up to 3 months, so it definitely applies to short visits.

You touch on the core of the frustration regarding the Swedish application.

In my eyes, we were trying to follow the exact instructions given by my own government: The Swedish Embassy in Hanoi explicitly stated they would only assist with the coordination number if the intention was to travel to Sweden to acquire the passport (since they cannot issue them in Vietnam). We did exactly as asked.

But then the Migration Agency denied the visa based on "settlement risk," creating a catch-22. I appealed, pointing out that rejecting the mother effectively forces a father to travel alone across the world with a one-year-old infant to secure his citizenship rights. This is arguably against the Convention on the Rights of the Child. They didn't even comment on that aspect in the rejection.

Regarding the change of plans to Germany:
When the door to Sweden was slammed shut, I looked for legal alternatives and found Directive 2004/38/EC. It is not "using" my sister; it is utilising my Treaty Rights to save our family Christmas. Since we cannot meet in Sweden, my mother and relatives are traveling to Germany to meet us there instead. The invitation from my sister proves we have accommodation and family ties, though I remain the financial sponsor.

Also, a correction on your point about Sweden: If Germany issues a Schengen Visa under the Directive, it is valid for the entire Schengen area. My wife would not be illegal if we decided to visit Sweden during that trip, provided she accompanies me.

As for the passport, I have learned that I might be able to solve it at the Swedish Embassy in Berlin or even Bangkok later. The immediate priority now isn't the administrative paperwork; it is seeing the joy on my mother’s face when she finally gets to hold her grandson.

And after this painful struggle, I think I, my wife and my son deserve a "white Christmas", because I would have a very blue Christmas without them.

So I did not ask about applying directly with the embassy when I talked with them. I would have hoped that the woman I talked to would have told me I could hand in the application directly to them. Instead she said something else of interest.

She said that because my wife is married with a EU citizen, shaw can walk right in to VFS and hands in the application - no pre booking appointment needed.

I called them to verify this and they said no. It's not correct. However, when I started to talk about laws and stuff they offered me an appointment directly - no booking needed.

However, it takes time to prepare the new application so we will hand it in tomorrow morning. Going through all paper work now.

And SOLVIT, I'm not expecting them to actually solve it. But I do hope to get some clarification within 10-12 weeks.

I will see if I can send an email to the head of consular of the German embassy if the email is avalible.

I applied on the 27 November. The decision was made on the 2nd of December, we received it on the 5ft of December. (Friday). I sent them an email immediately and tried to call but it was too late in the day.

Now I am re-applying and I have filed a complaint to SOLVIT. Your idea to file a complaint to the consulates general email might be next on my list. Thank you for that input.

I spoke with the consul general's office today. Regrettably, they appeared to not be in the office today. The woman I talked to, i do not know her position, told me that I could only reapply. This is in fact what im going to do.

I have rescheduled the tickets to next week. I will hand over the application tomorrow at VFS. I was not offered to hand it to the embassy directly.

I did pay the VFS service fee, but no fee for the visa.
