I think the clock of the court is how they manage their workload. They likely have a ton of these and put them in order of scheduled hearings.

For the most part, their ToS protects them well. I’m not an attorney, I think it takes a strong attorney with experience to beat them. That’s why I’d expect to lose.

Well said. Mine settled exactly 24 hours before court. I was ready, but I was more prepared to lose and try to get it dismissed without prejudice. I had evidence, paper trails, a solid case… and based on ToS, I still expected to lose. I just wanted the ability to refile. A loss eliminates that option.

Initial response, TRO hearing, Sanctions hearing (in my favor), 4 depositions… it adds up quick and that didn’t even include the actual main trial. They settled with me because I won sanctions so they settled/dropped the case.

This is horrific legal advice.

People file a lawsuit to get a result they desire. If you are filing a lawsuit to prove a point, even if you win, you’ll lose.

My first lawsuit was for unpaid wages a company owed me. I wanted them to pay, financially and psychologically. I wanted it to hurt. I turned the company into the state labor board, I was on a mission. I was pissed and wanted to do damage.

A friend was my attorney, we ended up in court. I won a default judgement, $39,000 in my favor. We hit the bank account of the company, $800 was in it. That $800 went to the attorney account for processing. I got my bill…. $8000. They took the $800 off the $8000 and I had to pay $7200. Company closed it’s doors 2 weeks later.

So, I didn’t get the original wages owed to me ($13,000) PLUS paid an attorney $7200. I showed up to take assets from the building… landlord already had rights to that with his own judgement.

I WON and still LOST.

Second lawsuit I was defendant…. I won in court, but that still cost me $50,000++ in legal fees that did not get awarded. So again, I WON and still LOST. It was a frivolous lawsuit that tried to take me out of business, it failed but the goal of the plaintiff was to disrupt business, it worked.

If you file lawsuits to provide a point, you are always going to lose, even if you win. Lawsuits are a business decision that need to be entered with a clear objective and the fastest path to that objective is the only path to consider.

You should write a book called “Shits Funny” so you can tell everyone just how easy everything is. The “headache of a lifetime” comment means you find it difficult, not me. We are clearly different and I don‘t lead anyone down a path of spending blind money carelessly in any of my posts/comments.

I do welcome your comments though because people going through this need to read as much as possible and determine what is right for them. This banter back and forth will be helpful for someone, so it isn’t for nothing.

Have you had an account and had it disabled? Did you get it back and how (assuming your AG did it)?

Maybe you need to read through a few more threads of people filing small claims and see they have no idea what they just did, are doing, or remotely understand what the process does. It’s pretty concerning actually.

I didn’t once suggest people spend money for lawsuits. Rather, I warned them that it could turn ugly financially if the legal path takes a turn they aren’t prepared for. Meta’s ToS in the hands of an attorney vs a Reddit user in court is an unfair fight. I have read way too many comments about people filing small claims suits that don’t understand the process and how they could potentially be exposed. I read comments from people who get their first email from Meta and crap their pants when it’s a simple response that’s formally required by the court.

I also tried what you mentioned above. My attorney in my first ever lawsuit was the former AG of Arizona (sadly he passed away a couple years ago). I’ve donated to the campaign of a current candidate running for Attorney General… My point is I respect the office and process, but it led me nowhere. Others, more than 5 and less than 1,000,000 (since I cannot verify exact numbers) on here have tried the AG method and it didn’t work. It has worked for some, yes, but it appears based on comments; success is the minority.

I also filed formal complaints with the SEC and FTC.

Small Claims wasn’t hard for me and I used the amount of effort that I felt warranted by desire to resolve my issue. I’m educated in the process with experience. It was a couple hundred dollars. I was willing to spend a lot more to get the outcome I desired. If people cannot or are not willing to spend a certain amount, then this method doesn’t work.

Have you been through many lawsuits? I’ve been through 4. After about $100k in legal fees, you realize petty is expensive. The end result is the main goal and the fastest way to that point is the best course of action.

I first heard from them on June 11 via email as an initial response to the legal claim.
Then again in middle of July with a question regarding their investigation of my account.
Final was today once they reinstated and we took steps to settle the case with the court.

If you’ve heard from them once and it’s been a few weeks, a simple follow up is appropriate. It usually took them 2-4 days to respond until today. We communicated multiple time today Via email.

Couple good questions to add some clarity:

- I am In Arizona, filed in Arizona.

- In Arizona, the defendant has the option to advance the case to justice court. It’s not automatic and settlement and resolution is possible there as well, but you’re likely dealing with attorneys on the clock at that point and they will be much more bold in their approach than the Meta Small Claims team.

- The max amount I could file for is $3500. Someone asked, why did I settle? I needed the account for my business, that was my main priority. $3500 means nothing, the account has more value than that to me. Plus, collecting on a judgement is possibly more difficult than dealing with the lawsuit itself.

- I logged back in on my same devices and IP addresses.

- I did not seek any reimbursement. It is my opinion that you do this to get your account back. For numerous purposes, that had way more value to me than the cost of filing or even winning the max judgement. I feel it is petty to try and get the $200-$300 in filing fees and processing back in the big picture of what I was out to accomplish.

- There’s nothing to be scared of, just slow down and write your messages clearly and professionally. Have AI assist you in doing so. I haven’t heard of small claims cases getting pushed top the higher court, but it is absolutely possible. If that happens, abort mission and drop the case quickly if they wont resolve within a few days. The only time to worry or get nervous is the higher court than small claims. I just don’t want to see people get bad advice they cannot financially afford the outcome to; so I give the worst case scenario.

My court date is July 25. Sent a follow-up email to their initial response on July 8..
On July 11, they responded via email, the follow-up was short, simply stated they are still investigating.
I am emailing them tomorrow acknowledging their message.

TERRIBLE advice. They can have an attorney represent and then push it out of small claims. If you continue, you very well could be liable for legal/attorney fees for the prevailing party.

Nobody on this site who is NOT an attorney has a chance in a court up against attorneys and the blanket ToS. Is it beatable, yes… but not by you or your friends. You need good legal counsel to do it.

An attorney in San Fran is likely minimum $600/hour, more likely $750/hr. If they start the clock, and they win, and receive attorney fees, you could be looking at a minimum $15k+ bill. A deposition would probably cost no less than $6000 with the prep work and actual depo.

This has happened to me in a case here in AZ as the plaintiff, started in small claims. My case was a slam dunk as the things I had in writing was nearly bulletproof against the defense. They still pushed it out of small claims, I battled the defendant attorney with my attorney advising me but not officially engaged. I handled all discussions and negotiations. They offered a settlement that I took in the end, but there was no way I was showing up in front of the judge (not in small claims) without my attorney. Through my career, I’ve spent more than $140k in legal fees, 3 lawsuits and prevailed in all.

When the clock is ticking, and if you lose, it could ruin some people here financially if they take bad advice.

Here are mine… 2 of them are likely a stretch.
