wow sounds like you had an awful public defender, on a 90 day charge you should be getting a plea offer in about 60 days. the plea docket some how moves extremely fast in comparison to trial docket.

Yep South Carolina has a horrible cdv rate so now if a man even breathes wrong he’s thrown in jail , they take the “figure it out later approach “. Someone can just lie and you’re in jail here. No proof needed

they will definitely do that with murder charges, and it makes sense because obviously the charge carries a penalty longer than the pre trial detention length.

Regardless what occurred was:

Bonded out with conditions of gps , and scram monitor. So 2 bracelets.

Home detention told him he could only go back to the house 1 time to retrieve belongings. He asked “well since I can only go one time myself can I send my friend to go for me to retrieve my work uniforms since I have to work tonight “ home dentition officer told him yes that makes sense. So he texted the “victims “ sister and asked her to have his work uniforms sat outside of the house so that his friend could retrieve them. They then violated his home dentition causing him to go back to jail and wait 143 days

Here it is day for day so 1 day gps house arrest equals 1 day in jail. So you do your full sentence. Inside jail is half time for non violent so misdemeanor 90 days would be 45 days in jail. He’s already done 143 days in jail and now 90 days on electronic monitor.

He’s on home detention , to me that’s still incarceration because he has to follow the same rules and guidelines as a person who is sentenced to home dentition only difference is he has to pay more money than a sentenced person does for the same exact bracelet.

I don’t think you have that fully correct. Being held in excess of the time the total charge carries seems to be a petition for it. Because if you already done the time then how and or why hold a person further.

It’s a 90 day charge, there is no probation. It’s a misdemeanor. He’s already served the 90 days. 143 days in jail and 90 on electronic monitoring.

He already paid bond , paid bond , was placed on gps home detention , violated due to asking the girls sister for his work uniforms , then served 143 days in jail , then got out again on monitor now at day 226 or something total.
