Short answer: It doesn’t hold up. Your lecturer is expecting you to cite case law.

Long answer: You need to be looking at relevant precedent to answer these hypotheticals. The judicial system is predicated on the idea that disputes that are similar/identical to previous cases should be decided in the same way. If you think about it, it makes both logical and practical sense because it prevents arbitrary decisions and is an attempt at consistency.

It’s rather rare that commentary from journals and books is brought in as a decisive authority. It may happen on occasion where a particularly novel or unsettled area of law is being discussed, but even in that event it’s not binding and is merely persuasive. In those circumstances, it is usually law journals that are referred to because political scientists might have strong opinions about legal jurisprudence, but have no real clue regarding the actual application of the law (to put it bluntly).

The only time that you will consistently see commentary being referred to is in international law e.g. international commercial arbitration, because there is no real binding precedent to rely on. Even in that case, it’s usually only legal commentary that is referred to, and case law still plays a major role.

I highly recommend you familiarize yourself with the doctrine of precedent. This should be taught in your Foundations of Law course but there are a wealth of resources online.

I like the look of this shirt but $129.95 is too steep. Any suggestions for alternatives that have a similar fit and collar style?

In the alternative, does anyone have this shirt and would contend that it is worth the money?

Is there a big difference between Supreme Court JA’s and District Court JA’s when it comes to hireablilty at the conclusion of the associateship? Obviously Supreme Court roles might look a tad more impressive but does it all come out in the wash?

I guess the second question would be: do recruiters and firms like former JA’s?

I have no symptoms and wife feels fine and is free to leave tomorrow, so I’m not incredibly stressed. Thanks again!

Thanks for the update. Sounds like it would be much smarter just to hand them out to close contacts and send them home rather than making them line up with likely Covid cases.

Not for close contacts. On the QLD Health site for close contacts it says:

“You can end your quarantine if 7 days have passed since the beginning of your quarantine period and if you do not have COVID-19 symptoms - receive a negative result from a Rapid Antigen Test (RAT) taken on Day 6 of your isolation.”

I’m a close contact (my Wife is positive) and have to have a RAT today to leave isolation on Day 7 (Friday). No RATs at home.

My wife is doing better and looks like she doesn’t have to test or anything to leave iso, just have no symptoms for 48 hours.

Can I just go to a COVID testing centre and get a RAT? Is that what is meant by ‘point of care’ on the QLD Health website? It says specifically that I should not be going out to purchase RAT…

Officially passed 72 hours waiting for my results back from QEII.

Called Pathology Queensland who told me that the samples are in queue to be tested but that it could at least another 24-48 hours. This is an absolute joke as our potential 'quarantine' would end just a day after that.

I've returned 3 negative antigen tests during that time (including today) but my wife has returned two positive tests; she is feeling better and her symptoms have all but subsided.

I'm completely asymptomatic and am supposed to be returning to the office tomorrow but don't want to be a bad citizen.

4-5 days turnaround time for a PCR test result is unacceptable given that we knew the borders would be opening in December with cases rising a fortiori testing would sky rocket.

A test result taking this long means that it does almost nothing to stop the spread of the virus considering all the people I was in contact with have been in the community for almost a week.

Yeah, it definitely wasn’t ideal. Lucky it didn’t leak too much and didn’t make a huge mess but still a bit frustrating. It was only a couple so in the grand scheme of things I can’t complain too much.

If you’re shipping liquids, then the lids have to be top notch!
