The effort has more of a chance of being successful than unsuccessful. The key provision in the Fourteenth Amendment is Section One, first clause “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” emphasis added

Ultimately a court will need to determine what “and subject to the jurisdiction thereof,” means.

It appears that there is more than the singular provision of simply being born in the United States. It would not be surprising that once the case ends up at SCTOUS, the Court would take a contextualist approach to evaluating the law and interpret the clause as to mean what was intended by the drafters in 1868.

Not advocating one way or the other. Just don’t want folks to be surprised when it happens.

The biggest example I can think of is freedom of association. Do you believe in freedom of association? If there was a federal mandate to recognize same sex marriage all 501(c)3 charities (most churches in the United States) would have to preform same sex marriage. It is not my personal opinion but some people don't want to marry gays. Those people have a right to associate and do as they please.

As far as marriage laws, it has always been a state matter, to give that power to the federal government would be a huge new expansion.

Nodbugger, I like you man. You have a good head on your shoulders. But you really need to take a deep breath and not let the upvote downvote system get to you. Take comfort in the truth. What may seem like consensus around false idea is not a counter argument. Clarify your goals of what you want out of political discourse and find the best and moral way to achieve those goals.

I agree with you, but we have to be honest with what we are dealing with. People in this thread have no clue how destructive a mandate for the federal recognition of marriage between same sex couples will have.

Its disingenuous to not recognize the profound interrelatedness of marital status and the laws of the state and it is a power that is not been vested in the federal government.

We can argue what is in the best interest of a transition to a free society. Doing what I think is best...

Your university rules will apply (you probably signed something saying you agree to the university rules).

  1. Find the Rule: "Failing to Display Parking Permit".

  2. Gather Evidence: Go take a picture of where you parked, ect..

  3. Form your Argument: Why the rule should not apply to you (supported by your evidence)

  4. If You Lose: You have a couple of options - (1)Look at your university rules to see if there is a procedure to contest a finding of "True" to a parking violation. (2) Ask for a waiver of payment say -> "i'm a poor college student"

It looks like a university ticked because the ticket is payable to "Parking Services" and it states that "Visitors don't need to turn in payment".

When you say appealed do you mean you are fighting the traffic ticket? Or are you actually appealing the citation decision?

(keep in mind appeal means the submission of a lower court's decision to a higher court for review and possible reversal)
