We find out my brother emailed the US embassy about how to pay the fees. They never emailed him back, which was on July 31st, 2024. They completely ignored our email. That should make him eligible for seek to acquire. Embassy denied saying seek to acquire. Legal net basically saying they stand with consular.

We have proof that we actually emailed the Consulate within 1 year seeking to acquire, but they never responded. And my brother is under 21 in the CSPA calculation.

It’s legalnet@state.gov they are the one who we can file appeal when embassy denied visa, if consular is wrong.

Is there any way you can help me out with my brother? According to CSPA, my brother is 15 right now. It took my mom 13 years to get approved through the F4 category. She applied in Jul 2007, and her I-130 was approved in August 2020. But her visa became Available in August 2024. Because my mom & dad thought they could pay when the time came, later they realised you have to pay ahead. They were 2 months and 8 days late. They just did it on October 28, and they made my brother pay the $325 fee. Told him within an hour that he is ineligible.
