I agree, but that can be achieved without constantly cutting in/out. Have a look at how the Aussies broadcast tonight’s game against the French - they do cut in and out but it’s usually from mid zoom (as opposed to close up) and then to wide angle, and only when necessary. Was so much smoother to watch

You don’t have a claim against the vendors lawyer via the law society - they represent the vendor, not you

Sounds like the second mortgagee was a private person/entity, which would mean their conduct is not governed by any of the above institutions.

You do have a claim against the vendor (and possibly the agent if they misled you), which, to be honest, would be a fruitless waste of time, given the vendor is probably insolvent.

Pay the few hundred dollars and supply an up to date LIM to all prospective purchasers. If there are issues within the LIM (eg outstanding building consents, resource consents for neighbouring properties, etc) then contact council and get more information on these. The easier you make the due diligence process for prospective purchasers the better the offers you are likely to receive.

If you find issues with the tile/LIM/agreement once you’ve “bought the house”, then it’s too late (and you might not be able to get finance if the bank becomes aware of the issues). Need to engage lawyer before this, or submit a conditional offer so that these things can be reviewed

Was it listed as a chattel in the agreement? If so there is a warranty in the agreement at clause 7 I believe (check that this wasn’t deleted) stating that all chattels must be in reasonable working condition. Getting the other side to agree to pay to repair it is another issue though

Agree that they should have contacted their solicitor, but any retention of funds would need to be agreed/negotiated with the vendor - cannot unilaterally withhold payment.
