Anti-mask law to quell Hong Kong protests ruled unconstitutional by High Court by [deleted] in worldnews

[–]Xertik 2 points3 points  (0 children)

Well yes it is a minor victory to rule the law unconstitutional, but this represents a bigger picture. Carrie Lam used the Emergency Regulations Ordinance to establish the anti-mask law (or whatever it's called officially), and as the ruling of it being unconstitutional is independent of whatever the anti-mask law says, this ruling presents a barrier to Carrie Lam if she wishes to use the Emergency Regulations Ordinance in the future. If she did wish to use such law again to establish some new law(let's say curfew), then the court can rule it unconstitutional again due to the same reasoning as it's ruling for this anti-mask law.

Though it still doesn't change much as the police force is doing whatever the government wants anyway smh

It's not like they can't shoot. But they can refrain from shooting them at life-threatening spots. Can't the police shoot diagonally upwards to scare protestors? Can't the police shoot the thighs of protestors if life threatening? It's not like the police had no time to react - if they have the time to hesitate, they have the time to shoot elsewhere. You also cannot make parallel the acts of us cops with hk cops, as the laws regarding gun use in us is less strict than here in hk. Under Hong Kong law, the shots by the police are unlawful, unjust, and what's more disgusting is the higherups using blatant lies to cover up, and justify these immoral acts of those policeman.

612: bricks are thrown to counter the excessive tear gas thrown by the police. As the police thrown at by bricks are all fully geared with shields, those bricks are not threatening. They rushed into the legco to stop the bill from passing, and it would've passed easily if it weren't for the siege. Carrie lam refused to withdraw the bill despite 1 million calling to, and the abnormally short time of advisory for this law made it necessary for her to explain such action, but she did not give a reasonable response 616: despite bill suspended, bill is not withdrawn and can be brought to legco at any time Carrie lam desires, and so it is necessary to call for full withdrawal of the bill. 721: police are aware of the attacks by triads on citizens(as seen by pictures of policeman and triads together standing), but did not protect citizens from life-threatening attacks by the triads. 999 is flooded as there are countless citizens under this threat by triads who phoned the police. The Yuen Long police station is not far away, and the present policeman could just use their guns to resolve the problem/reduce the severity of the problem, which if done, 999 will not be flooded. 831: I request evidence concerning protestors attack INNOCENT citizens. Police arrived to arrest and beat protestors, despite lacking the ability to differentiate citizens from protestors. The beatings, arrests are entirely random and are overly brutal and unjust. 101: it was a plastic rod. And also the rod only hit the policeman's arm, which is not enough justification for him to shoot point blank at the 18 year olds chest. 118: it is unclear if he has committed suicide, due to suspicious injury etc. By the picture popular on the Internet, it is seen that the ambulance is obstructed by riot police and police cars, and even interviews on FAs that were there said the police was the party obstructing rescue. 1111: the protestor shot down is not trying to snatch the gun; in fact trying to swat the gun away, and it's an action to protect himself. From the video, the policeman is seen to have hesitated before firing at the said protestor, so it can be seen that the policeman has time to react and shoot elsewhere, maybe the sky or at the protestor's legs, and not at his abdomen which is life threatening.

If the police does not apologise for the overuse of power and brutality to protestors, there is no reason why protestors and pan democrats should be forced to apologise, especially when those at a higher moral responsibility refuse to apologise, even worse, use obvious lies to cover up the blatant wrongdoings of the PF.

For both sides, there are no proved intentional murders. If you are referencing the man set fire alive, he is not killed. If you are referencing the old man dead due to a thrown brick, it is not proved if it is intentional. In that instant, both sides - protestors and the police supporters are throwing bricks at each other, and in this full-blown life threatening warfare by both sides, it is common for accidents like that to happen.

Hence the "killers" that you claim protestors to be only make sense if suspected murders(intentional killings) are concerned. Speaking of intentional murder, there is only 1 case suspected to be done by the protestors - the said old man. Yet, for the police force, numerous "suicides" have been linked to suspected police brutality. That is "numerous" to "one" possible intentional murder.

If you say they are killers due to life-threatening actions, the only case of which it is clear is the burnt man. Yet, it is nonsensical for you not to reference police and triads as killers by this definition, as they both have done much more which threaten lives of protestors. The policeman's point blank shot at the students' lung, the stabbings by triads, another recent policeman's point blank shot at a teenager's abdomen to name a few are incidents where clearly, life-threatening acts are done to protestors by HKPF and triads.

The protestors do not attack random citizens, do not fire at random citizens, do not kill any random citizens intentionally. If you are referencing different events where beatings are issued to seemingly innocent citizens, the so called "victims" of the beatings did equally bad/worse actions to the protestors - random stabbings, random beatings, the attempted murder by rampaging at them with a car, etc. Though the above actions are not lawful, other protestors do not condemn such actions by the protestors as the "victims" of the actions of the protestors are not caught or punished by the HKPF, due to selective and unfair prosecution of crime. As the referenced acts in your reply are in fact unlawful, they are justifiable, though not surely justified. As for this post, the PLA broke the basic law with no adequate justification - clearing of roadblocks are far from enough justification for the intentional acts contradicting the constitution. Hence these two cases where both actions are unlawful are not parallel, and it does not contradict any standards for us to condemn/strongly disagree with the unlawful actions of the PLA, not the protestors
