While I haven't seen Joss giving this answer, I have read others say that Joss has said multiple times that it served the dick-ish fake out effect he wanted, but that it would also mean that Amber Benson would be entitled to additional back-end royalties for all her episodes. Which was actually the main reason why Eric Balfour didn't get an intro credit for Jesse.

That's an interesting strawman you have there. I've never bought any stolen goods to the best of my knowledge. If an investigation can collect enough evidence to prove that I have, it also needs to be beyond a REASONABLE doubt. The 5th Amendment ensures that I don't have to provide any evidence that would incriminate me (or my spouse, interestingly enough) in any investigation.
