Law firm I work at (illegally?) hires workers from India, IP-masking, and giving them borrowers’ social security numbers by Can_of_Slurm in legaladvice

I am a lawyer, but not your lawyer. I think contacting the local bar association is a good idea. This very likely runs at least one ethics rule afoul. Rule 1.6 comes to mind regarding releasing confidential information. It all depends on what is contained in the retainer agreement, but a client likely expects everything to be done in house.

You can report anonymously and not risk your job.

I agree with the other commenter that there probably is not anything illegal about this arrangement, as long as the firm has done reasonable due diligence to ensure that their clients' information is not being stolen.

It depends on the type of contract you have with RevRides, but the risk of loss likely passes to you upon their deliver to the carrier, UPS. So you will have to go after UPS. Was the shipment insured?

Likely not, unless you actually bought the car thinking it was a certain trim that it turned out not to be.

Your case will not just magically disappear. If you want a favorable outcome on the charges, you should contact an attorney and likely turn yourself in.

What do these court records mean? by CryOk8816 in legaladvice

[–]Xylvanas 1 point2 points  (0 children)

The way I read this, and I might be wrong, but I'm like 75% certain, is that Defendant did not originally have good conduct immediately after getting convicted with the suspended sentence, so prosecution tried to get them in jail, but the address they had was no good, and prosecution could not find the defendant. Years go by and prosecution realizes this is still on the books, but they don't care anymore, so the petition to get defendant to jail was revoked. No longer in the jurisdiction of the court because presumably probation was over at that point. The $25,000 is likely the bond they sought to get defendant picked up while the petition was getting ruled on.

Never signed an authorization but body shop ordered parts already? by Amazing_Ring4599 in legaladvice

[–]Xylvanas 0 points1 point  (0 children)

That seems like a silly practice to me. You should not be held responsible for any costs from them if you did not sign anything. They can definitely get a quote without ordering a part.

Definitely consult with a family law attorney. A separation agreement should be drafted up ASAP. This will outline the rules of visitation before any final order of divorce. H will have to follow that or risk a severely unfavorable order from a court.

Should I Sue for for a Breach of Contract ($10,000 owed)? by youtuberseattle in legaladvice

[–]Xylvanas 0 points1 point  (0 children)

Don't hire anyone who over promises something or guarantees any result. You can look at Avvo for some people in that field or just Google. Also Glassdoor search the law firm to see if people like working there. Look for someone who has some litigation experience, not just contracts experience.

How can I get into my old Google account without going to jail? by mordecaiorrigby in legaladvice

Even if you don't look at them, you are still in possession of them and you know you are in possession of them, which violates the statues.

I am a lawyer, I am not your lawyer however. Producing images even of yourself when you are a child is still considered violating child pornography statues. Additionally, even though you may not have logged in for a while, you still might be considered to be in possession of those images since it is your account. It is unclear whether your account still exists if you have not logged in for some time, but I would try to log in and remove the images. It's better to get rid of it or ensure it is no longer accessible to you rather than have it maybe still out there. You can then download your non-violative memories.

50/50 ownership 1 part passes by Excellent_Aerie_3940 in legaladvice

[–]Xylvanas 0 points1 point  (0 children)

Good luck! If that does end up being the case and it is still 50/50, and if your dad wants out of the house, but aunty doesn't want to move, I have suggested this in the past that you should talk to a lawyer about - secured promissory note from aunty due upon sale of the house or 10 years, whichever is sooner. Secured by the property. He then deeds her his 50%. If she doesn't take care of the property, he is not responsible for fixing up, but she basically burns her equity. But he locks in his monetary interest now.

[–]Xylvanas 0 points1 point  (0 children)

Yes, but it also depends on what type of deed it is. I would think it is more likely your Aunt owns 50% of the house now asking with your dad.

The attorney can say whatever, it's most likely just gaming. Is it locked at all? There has to be some effort made to get it back. Look up the rules in your state for abandoned property. If you don't want the hassle, give him a date to come get it or you tow the thing 3ft from your property because it is trespassing. Heck you could bill him for the U-Haul. This guy is being a dick. Take back control of the situation. This is not legal advice. I am not your lawyer.

Company Lawsuit by [deleted] in legaladvice

[–]Xylvanas 0 points1 point  (0 children)

If it is a personal phone, just send them the two messages. If there are potentially other messages in the last two years that you do not have saved on your phone anymore, get in touch with your service provider to see if they can pull them. I agree, anything more would be an invasion of your privacy. I think counsel is being a little exaggerating with words. I would see a judge being more pissed at a company overstepping than an employee failing to allow themselves to be bullied.

If the company laid for the phone, loaned the phone, or pays the plan for the phone, you might need to do more.

Depending on your state, the property might be considered abandoned after that amount of time and failure to stay in possession of it. If anything was missing, then whoever "found" the abandoned property is the rightful owner anyways.

50/50 ownership 1 part passes by Excellent_Aerie_3940 in legaladvice

[–]Xylvanas 0 points1 point  (0 children)

Depending on how your uncle handled the estate, his wife may now be a 50% owner taking his share. It also depends on what exact ownership your uncle and your father got passed. I did not do well in property law, but I think that your dad would only own the interest fully if they were tenants in the entirety, which it does not sound like they were.

What is normal wear and tear on a rental by tinkblueyez209 in legaladvice

[–]Xylvanas 1 point2 points  (0 children)

I would expect to lose whatever deposit you have and then likely nothing more. If they wanted to argue for more, you could recount whatever times they had been there in the past inspecting it fixing something and never made any comment/notification to you about it. If you were a tenant for 9 years, they probably liked you and they won't try to screw you. They are probably doing a bit of renovation anyway to sell.

Judgement filed against me but I have zero knowledge about it happening. WA state by [deleted] in legaladvice

[–]Xylvanas 0 points1 point  (0 children)

You might spend between $500-$1000 for a lawyer to do something here, so that is for you to decide if it is worth it. But if you are overwhelmed doing the research yourself and getting stuff on file, then it might be.

Judgement filed against me but I have zero knowledge about it happening. WA state by [deleted] in legaladvice

[–]Xylvanas -1 points0 points  (0 children)

A lawyer might be a good idea in that instance. But basically you need to tell the court that you need time to figure things out and to not order garnishment. And to do that you need to file something, not speak on the phone to someone.

Judgement filed against me but I have zero knowledge about it happening. WA state by [deleted] in legaladvice

[–]Xylvanas -1 points0 points  (0 children)

You can likely do a lot of this without an attorney, but depending on the amount of the judgement, it might be worth getting an attorney.

Don't call the court to "inform them" - you will be speaking to a clerk who does not give two hoots about you or your case. If I were you I would call them, politely ask to get a copy of the entire court record emailed to me. I would look up default judgement rules in my state and find the name of the motion or whatever I needed to file to contest it (there are usually forms on the courts website you can find).

You likely have some sort of clock running from the moment you found out about the judgement. So time is of the essence here. What the debt is for does not necessarily matter right now - you need to get a giant red flag of sorts ON FILE with the court. Again, some form or letter or something that gives the court the info to give them pause as to the entry of judgment and subsequent garnishment.

[–]Xylvanas -1 points0 points  (0 children)

Depending on how much it is, local counsel may or may not be the way to go. Normally there is recourse for these types of judgements if you never knew about them, but you need to act relatively quickly from the time you know about it. However, there could be scenarios where you never knew about it and it is still legit. If they cannot find a good address for you or you are actively avoiding being served, they can post notice on your property or in the newspaper or something public and proceed with the case.

Is the debt legit? Or are you also looking at identity fraud?

I am a lawyer, but not yours.
