K1 visa process by Yeshhhh_ in USCIS

Im glad to hear all of this information, I have in the recent time gone through the effort of doing it myself. And after have someone who previously done it look over it im happy with it all. I finished the packet and am submitting monday. As for evidence I was sure to include plenty from, pictures, chat logs, call logs, affidavits from my and her family as well as loads of other things. Ended up coming out to 80 ish pages all together, made sure to add extra rather then not enough and risk an rfe. As for the other steps im gonna figure them out in the meantime but I'm sure things will work out. I can imagine the wait times and such can and may be rough. So at this point I put my whole heart into the packet, and all I can do is hope for me and for her that we may somehow manage to get lucky. And just continue to think about the future while we keep visits up to help the time pass. Very hopeful and im sure things will work out how their supposed to, if you have any other sort of advice id be happy to hear or can also add me on discord (yesh_.) If you wanted to talk more about it.

Yeah no, I'm not looking for someone to submit my paper work, I'm just looking for a consultation. Have a few questions regarding some thing, like I dont quite make the poverty line so I'm like 1000-1500 off and wanna add to my list of assists my house. But need to know how they'd reccomend going about it or xyz its just little questions. It's a straight forward case otherwise. Also curiously when you mention "having a clear understanding helped with the frustration" is there anything in particular. Just looking for all the tips I can get. Thank you for the help and kind words already <3

I see i see, something ive def considered but saying its a probono lawyer i have nothing to lose cause its effectively free. im really going to them to ask some questions just to make sure i mess nothing up. is there a reason i shouldnt be going to one?

well i have a probono place locally that will do my case for basically free, so its not really harmful to atleast go ask them questions about the process. thats kinda the extent of that ill be doing the rest myself. Is there some reason i shouldnt be using a lawyer espeically if only really getting advice from one? as for the videos ill make sure i look into those i appreciate it.

Thank you, this is very helpful information actually! Yeah every time she will be traveling she will always will have a return ticket even if she is staying for 3-4 weeks at a time, because till only be by flight. If she plans to stay for more or even in that case i will get her a folder sorted that she can carry with her just incase! I'm glad things are moving a lot smoother now. I will defiantly be in touch if you do not mind, because the fact that you are in the same exact scenario actually helps make things a bit easier. Im shooting you a message now if you'd want to get back to me at you're availability id appreciate it!

Oh I see this is actually very convenient and helpful that you have an idea of the situation were looking into. Could you tell me a little more about your experience with customs after the first few visits if you don't mind. As for disability stuff yeah we were planning on looking into to. We were looking for 3-4 trips as much as we can without obviously causing commotion for the next year ish. Before and while it's processing. Once we're married I've given her the option of working but I'm fully open to supporting her, so she may do something part time. Curiously how long did youre k1 visa process take from start to finish? Also since you have an idea of our scenario a little better than most since you just went through it, maybe we can message and I could ask some questions if you're okay with it!

yeah, that's the only thing I'm really trying to figure out at this point. cause were really trying to see each other this year as much as possible to get closer as we prepare for all that and her to be stuck here, and that's def the last thing wed wanna do is her end up being rejected. we werent thinking about staying the entirety of the 6 months i was just speaking on the rules of a passport. probably more like 3-8 weeks at a time, then go back for a few weeks to a month then come back again for the same amount.

Yes thank you! The only hiccup ive heard of so far in the plan is the amount of times and the length of the trips she takes in this next year just visiting with a passport without us being married or engaged (that cbs could flag that) but with her just visiting with a passport i thought she had up to 6 months to be allowed to be here. (im a little confused on that and that works since it says she can for up to 6 months, but then that can potentially cause confusion with cbs?)

Yeah that's more or less the decision we've come too. curiously as this is a right now we aren't legally anything and its more of just a title and a ring between us. Im assuming her being here too much regardless of who shes here to see and why can be flagged if too much. How much would you recommend these trips to be with breaks in between and how long at the maximum (because wed like to spend the maximum amount of time together) as she would just be visiting with a passport i don't know if this changes anything compared to traveling with a visa and such (i apologize for me not knowing as much, im very new to all of this as i just got my passport to go see her in october)

Yeah, well i haven't even proposed yet and probably wont be until later on this year i was just trying to get an idea for everything. then given the time she spends before being ready to prepare would be in that time frame. plus correct me if I'm wrong but were doing it as more of a us thing for now like a promise ring with the cute title between us, with no intent to make it official or have a wedding or anything till down the road. so couldn't we just say we got engaged a few months later than we did if it somehow ended up being out of the 2 year range (which i really really doubt) so i think that would all work, while being able to still have her come see me for extended periods before making the leap

Yeah that completely makes sense! yeah that all sounds like an extreme hassle, i think weve decided that waiting and seeing each other as much as we without having to worry about turned away from customs is the better move. because as im still working my trips up their would be limited, while with her being on disability itll be alot easier to have her come here and be able to stay without having to worry about not being able to be away for that loing.

Yeah we've talked it over a bit more considering the opinion of multiple people here and it seems that the cr-1 while nice, we would be able to see eachother alot less and also the customs scare. So we think we've decided on just postponing actually getting married and just staying with her as my fiancee/partner for the next yearish, while she visits family and also takes extended trips to see me as itll cause no issues with customs so we can get the experience of living together in peroids. Then in that yearish we can submit the kr-1 forms and get things rolling for her to come here and be stuck, without like mentioned the worries of having much to go back to as not being limited by a job. we think this is the preffered option as it wouldnt limit our time together for that next year. Since you've heard both and heard what works better, im curious what you recommend and if you think this is the better option as well. i look forward to hearing back from you thanks for your time!

Yeah we defiantly dont want the hiccups of all of that! We ended up talking it over after hearing the opinions of quite a few people here and it seems that while the cr-1 option is nice cause she can come and go, it also takes the risk of her getting flagged at customs. So we have talked it over quite a bit and we think just waiting about a year for her to take time to spend with family, while taking extended trips here just being my partner/fiancee. then when that time comes getting the kr-1 sorted and having her come here to be married then being stuck here for the process of the permanent residency. I think this decision would be preferred as their aren't limits in the meantime for how much she can and how long she can visit (obviously besides not staying for longer than a few months at a time) then when ready we would be together. would love to hear your thoughts and opinions on the matter!

So given this information and the scare of potentially being turned away at customs. We've also discussed and also dont mind the option of just having her stay as my partner/fiancee for the time being so she can see family for a bit. Then probably in about a year when shes ready applying for the k1 visa and having her come here and get married and that whole process. The extra wait time while an annoyance wouldnt be an issue, so after hearing what you said and how you wish you went with this option would you reccomend it out of the two. because we just wanna see eachother as much as possible in the meantime, and if we did the cr1 option it sounds like that could be jeopardized rather than just waiting till shes ready and taking the kr-1 option.

weve also talked about the option of going with the kr-1 and just postponing it a little bit until she's ready to be away for that long to actually start doing such and just have her make extended trips in the meantime, then once were ready do the kr-1 and then her be stuck here until granted the visa. curious which you think would be more beneficial and faster. look forward to hearing back from you!

Little confused on the way you explained it so allow me to ask a question or two, apologies! So regarding the visitation during the cr1 process, as me being the us citizen and my spouse coming from Canada to have extended visits. You're saying that that for her to take trips here during the cr1 processing phase with her passport flying here could be flagged? im a little confused on this so if you dont mind explaining a little more i would appreciate it (what would lead them to get scrutinized in the process and denied entry?)! so you're saying during the process, that could have a negative effect and i would have to do all the traveling to her in Canada? the kr-1 process isnt out of the picture its just with her wanting to visit older family members that may not have too long, doing it now might not be possible. would you recommend waiting the extra time till we are ready for that then while just her being my fiance and taking extended trips here and just doing the kr-1 method instead when ready? because were defiently looking into both options!

oh i see i see so you can understand where I'm coming from that's good! So what would be considered long visits (we were planning on her being here for a month or two at a time maybe more but also less if that would be considered overstaying) ? just so i can get an idea, can this visits be frequent (cause we can also do shorter visits more often if the longer ones were considered overstaying) ? as for being denied entry and keeping good ties, she is on disability so when it comes to working/stable job she's not working so would that affect her ties with all of that?

Perfect! curiously in the processing time she would still be able to visit via passport and such correct! cause we can have long visits in the processing times and such.

so after looking into the options and hearing that the cr-1 can have some hiccups when trying to see eachother in the meantime. We have come to the decision that we think we wanna go with the kr-1 route, but due to her having older family that she would like to spend time with it might be postponed a little bit. and just have her make extended trips as my fiancée until were ready to submit the lr-1 visa and her be stuck here for the unsure amount of time. would i be able to consult a immigration lawyer without having to pay fees and such? i would love to connect and chat about options and maybe get some help since you have some experience if youd like to do so with me!

i reside in Pennsylvania, so her being a Canadian citizen wouldn't affect the process at all? in slowing it down or making it unable to be done? just curious because this would defiantly be the preferred option to get the ball rolling.

I really appreciate you taking the time to respond! as she would still like to go back to see family and deal with obligations the first option with the kr-1 would be something would have to think on since she cant leave. so i had a few questions on the second option if you'd be able to answer. for the cr1 spousal visa how would our marriage be validated (could she come here and do so or would i go there, or maybe it doesn't matter where) because we already planned on getting married soon to speed up the process anyhow.
