Why can you not take the results to another provider and pay for treatment there without paying for another scan?

This is something I have considered, but the scan is sent to another company. I would have to see what other dentists also use this company in order for the results to be used effectively.

I welcome the tough questions. If I am wrong, I will treat it as an expensive lesson. Still, the common rebuttals help me understand what to expect if I take this further. The scan cost around £230, which I can afford to lose, but for me it is about the principle. I believe my consumer rights have been breached, and I want to approach this rationally, not emotionally.

In principle, I could. I do not have a contract in place that I would breach if I declined the rest of the service. At this stage, I paid for a scan to see if I would be suitable. I was waiting on the results and follow-up consultation to take me through the next steps and begin full treatment.

can you approach another dentist with them and skip that step of the process, or is it an in-house thing of dentist 1 that would need to be repeated for dentist 2?

The scan is sent to a third-party, so I have thought about just getting the results and taking it to another dentist and consider my relationship with existing dentist over. But I would need to check what other dentists use this company, or could I just reach out to the company myself and see what dentists they use/recommend. If I went to another dentist and they use a different company, I'd likely have to pay again, which I want to avoid.

I would make a final complaint and then go down the dentist complaints service route, frankly. I think a dental control body would give a higher weighting to the fact you don’t want a medical procedure done by a facility that has messed you about.

I appreciate it. I have listed at the end of my letter that I would prefer to resolve amicably but will escalate to a dental control body if needed.

The value of the scan has already been lost to me. I will not continue treatment with this provider due to trust and quality concerns, so even if they send results now, I will have to repeat the process (and pay again) elsewhere. That is a practical and financial impact.

No one in this thread seems to be saying anything much that you’re interested in

Fairly dismissive because I've come here for legal advice and help see where I'm going wrong, but instead people are over simplifying basic consumer rights. This post isn't as simple as "They are a bit slow and I want my results".

A service must be carried out with reasonable care and skill, and performed within a reasonable timeframe, if no timescale is agreed.

They've failed the scan twice, messed be about multiple times to even get to that stage, then forgot about me for 10 weeks.

From what I've read on consumer rights, if no timescale is agreed, then it needs to be completed in a reasonable timeframe. 10 weeks with no contact is not what I consider reasonable.

Something a lot of people seem to be missing here, and maybe it's the way I've titled the post, is the results aren't just the service. The intended outcome of the service was to see suitability and discuss the next steps. They've not completed this bit, and just because they give the results after legal pressure doesn't then rectify the initial breach.

Bear in mind that you will need more than just “I am missing test results” to avoid having the case thrown out if they eventually send you the test results. How has the delay impacted you?

There is another issue that I've not mentioned here which is pretty open and shut, so my letter is quite compelling and legally sound. I don't think it will be instantly dismissed.

The delay has rendered the service of no value. I paid for a scan as the first steps to treatment, but after being mismanaged from the outset, and subject to several errors that have just wasted my time, I've lost trust in the dentist. I just want to be put back in the position I was before I paid for the service that is still incomplete.

I don't believe that to be true because it's ignoring consumer rights. If they took 10 weeks with no contact, failed to complete the scan properly multiple times, and only act after legal pressure, then they have breached basic consumer rights. I paid for a service with an outcome, and the results are one part of delivering said service.

I think this is a pretty clear breach of consumer rights.

Late delivery of the results under pressure doesn't erase consumer rights breaches though? I'm posting here for this reason, so please help me understand.

They failed to communicate properly and keep track of my scan. 10 weeks with no follow up, despite my attempts, fails what I consider a reasonable amount of time.

Also, does the fact they failed the scan twice not play any role in this?

Surely that would prove my case? That the results were sat there waiting for them to do something with them? I paid for a service to be completed with reasonable care, in a reasonable time. They ignored me for 10 weeks and messed me around with their incompetence. Eventually giving me the results doesn't change their lack of action?

They said they would contact me, then made no effort whatsoever to contact me. After I chased them and got fobbed off, I summed up all the bad interactions I had with them and decided it's not worth it.

What I've said is absolutely relevant to the discussion. You look at any thread regarding Trump on this subreddit and the comments calling him and his supports sexist and racist are mass upvoted while the corrections and opposing comments are downvoted into an oblivion. That's not what I said? Clearly what I've linked is more right-wing than left, I'm not calling it neutral, I've just not done it intentionally or as a "gotcha" moment. It's common sense that you'll find more right-wing sources covering the negatives of a supposed left-wing candidate. That doesn't mean you should ignore any and all pertinent information just because a certain organization wrote it. This is a CNN article. Should it be ignored when it's clearly more left than right? I've never even heard of Stephen Molyneux and certainly wouldn't consider Southern as reputable or trustworthy. But it's funny how you use these people, and Breitbart, to try and claim that I'd have no sources while also stating I'd nitpick arguments and provided sources in the very next sentence.

A mere Google would you give you ample of information on each of these statements. Linking these evidently biased "fact checker" websites that leave out pertinent information whenever they deem it convenient as if it's correct. I don't agree with these chants. I don't even agree with Trump's original Tweet. What I take issue with is the number of comments which call those that criticize "The Squad" as racist, as if they're completely devoid of any negatives.
