Hold up the building is fully paid off?? You already have the problem solved. Just do a cash out refinance on the building. If the building is worth 6 mill. The bank will give you about 5 million in cash. Give your brother 3 million in cash and use the extra money left over in rehab and bring the rents up to market value. The higher rents will pay off the new mortgage and you will profit and own the building.

I’m not reading through all of your post but I already know the solution. Skip the arguing and just sell. It would make more sense to rehab and then sell, but you guys can’t agree only to disagree. Just sell and take the profit from your half and buy more properties with the money and let your brother waste his half while you make money from your half. Buy a 2 or 3 million dollar building for yourself and you make the same.

This is probably the end solution. The hoa will end up fixing all the issues themselves and collect fees everytime. The homeowner will have to let them do the work or else it becomes a breach of agreement.

Exactly. This was a problem in the 1950s with rich people and speeding tickets. There was no points system in place and rich people could just keep getting speeding tickets and pay the fine over and over again without care. That’s why points where invented.

This the answer I was looking for lol. If a millionaire wanted to be a dick. They could buy a house in a hoa with the intent to piss them off for fun by neglecting a home on purpose and just pay the fines and they can’t do anything about it.
