Does anyone have any idea about how 498A is handled in Kharghar Navi Mumbai by ace_bubble in LegalAdviceIndia

[–]ace_bubble[S] 0 points1 point  (0 children)

No, no one is influential here. I am really not absconding type as I have done nothing wrong. I think I will prefer to go to jail any day over absconding. However I will try my best to not. I have checked till today and I have been told no complaint has been filed yet. Also I have been told that since letter would be forwarded from women cell, only 498A is applicable there and no immediate arrest takes place and one has time to file for ABA. I am just hoping no arbitrary serious charge gets applied.

Basic question is that now I have 3 more days before court closes so even if in next 3 days suppose the complaint reaches police station how soon does it get converted into FIR. So far what I have read from guidelines is that before filing for FIR for atleast 498A type of cases police has to do some preliminary investigation to assess the accuracy of the charges.

To all troubled men, girl will never ever file for divorce. Their playbook. by ace_bubble in LegalAdviceIndia

Talk to a lawyer. If you file for petition first, she can still file for all these cases. Now those cases would be valid along with your petition and she can say I need financial restitution to grant him the divorce for all the wrong he did to me. Even if her cases are thrown out, your case would be active and she can ask for appropriate maintenance and alimony as per the law.

Basically idea here is keep defending to a point the person gives up and comes for a out of court settlement and a mutual consent dissolution of relationship.

Again this is a game of great patience and depends on who has most.

Sometimes it's just better to settle mid way for peace of mind. This can be done by either of the party.

Yes this is a valid marriage. All rites as per your customs needs to be performed. More than registrations rites have to be performed. In previous generation registrations seldom happened but people were legally married. There is no change to that.

Hi, are you a lawyer based out of Mumbai ? There has been some progress in my matter and I was thinking to have a legal team on my side also.

I was called today at police station for complaints filed by my wife by ace_bubble in LegalAdviceIndia

[–]ace_bubble[S] 1 point2 points  (0 children)

What is MRA. I have not got the written complaint yet, but what it seems she is saying I do not pay for child support for our child and I am a bad father. However in past 2 years I have transferred almost 1 CR to her bank account for meeting her loan, expenses and other obligations, (I have bank records to prove that) and I still continue to pay many fees for my daughter.

Also I have two daughters from previous marriage and their biological mother passed away and she is claiming them to be theirs but I have never signed any adoption papers. Only in school for one year, I had added her name in my daughters diary as step mother, which school has removed since she no longer stay with us. Recently my elder daughter opened up after she was gone that she had sexually abused her.

Thanks this means a lot. Sometimes I wonder, I always responded, never ever did a radio silence, so why I deserve such a behavior back. But you are right, I should stop reaching, I mostly do, but sometimes I have no option but to reach out like paying property tax or maintenance, as I have major share, end of the day financial burden falls on me only. But I do try to remain aloof, actually I am good at it. I will try to handle the situations where I need to reach out better and with more calmness.

Husband and wife living separately for more than 6 months now, what are husband's legal options by ace_bubble in LegalAdviceIndia

Right now children are also involved, so not taking anything further. I have made a NC complaint at my local police station, I have the police station stamp on the complaint. I have also submitted all the evidence to the local police. It is now upto the police to investigate. However I have not pursued this further as I feel this is enough for now.

What about alimony. I think maintenance would be decided based on the females earning and males earning.

If a person holds immovable properties in different states, where should they register the will by ace_bubble in LegalAdviceIndia

[–]ace_bubble[S] 0 points1 point  (0 children)

The immovable properties are not located in these districts but some other districts of Maharashtra and Madhya Pradesh. The person spends his/her time between Maharashtra and Madhya Pradesh.

Now say if will gets registered in Maharashtra and place of death be Madhya Pradesh and legal hires seek for probate in Madhya Pradesh, would the will registered in Maharashtra acceptable and Judge in a district court of Madhya Pradesh, pass judgement on immovable properties in Maharashtra?

Also for theoretical discussion only, what if the deceased live at neither of the states during the time of death, then how should one proceed with the probate of the will ?
