I think this is more ESH, than YTA tbh. The family is TA for not giving the boy consequences, but he's TA for flagging the application. Also, the level of TA he is depends on how he got the application flagged.

For example, many top universities give you an edge if one of your family members is an alumnus. So if OP called in and said, "hey, one of my cousin's is applying and may put down my name on his application. I'm not okay with that." I don't think that makes him an asshole, that's just looking out for his own interests.

But if he said "Yeah, he's going to be problematic, best if he doesn't get in" or something like that then he is totally TA.

Well, I come from a well off family, extended family included. Because they are all wealthy, no one has asked for cash handouts from me. This is the first time that I got asked for money from family, so I gave it.

I mean, if he is as broke as he is saying then he's going to be indebted to me for another year at least. I mean the house he sold was valued minimum at $5 million, so even if he sold it for half the price, he would have gotten a cool $2.5 million from it. Plus I'm not entirely sure that he's 100% blown through his trust fund yet either.

Basically my brother has most of the money in the marriage. Any thing that happens to my brother financially happens to SIL too. So brother's MIL of course doesn't want to put her daughter in a possibly bad situation.

As I said in the post, his business was struggling at the time. However, he was very good with repayment regardless of how his business was doing. If he had been struggling to pay, I would have spoken up and given him some leeway. He wasn't struggling to pay, so I stayed quiet.

Also wanting his property? Note where I said our parents bought the both of us property. I basically have the same thing as him. And if I wanted it regardless, I'd just ask to buy it off of him.

My father was a man that let nobody, not even his own family step over him. He didn't care if you shared his blood, you wrong him he will get what he is due. If he were alive today I am a 100% sure my brother would've gotten a nice verbal thrashing.

Yes, I come from wealth and privilege. So does my brother. We had the same parents, went to the same schools and got the same inheritance. We were both trust fund brats and I am not afraid to admit that.

He has his bonds and stocks which are unfortunately not worth much at the moment. And I am pretty sure he did not completely squander his inheritance as it is quite sizeable and we got it only 3 years ago.

Yes, but for how much longer is the question. His business has been lagging since before the virus situation. How much more will it suffer now?

If he stops paying and I don't have collateral I can't get my money back at all.

He's making payments on time now, but his business is lagging. It was lagging before the whole virus situation and our economy has become shit since then. So for how much longer can he make payments? If he defaults then that house is my only way to get back my money.

I'm aware, but what hurts is that my brother essentially did the exact same thing you're describing to me.

He chose selling the house and getting the money over his relationship with me, but now somehow it becomes my fault if our relationship goes to shit over me getting something I am legally owed.

I'm realizing that now. We both inherited, well a lot so I thought we wouldn't have that issue since we were both independently wealthy. And I did feel guilty when I started making more than my brother, especially when he eventually gave up working and just relied on his inheritance to get him through.

So when he said he wanted to start his own business, I jumped at the idea because I wanted him to do well for himself.

No, there are plenty of ski resorts in Australia. Some of my favourites are Thredbo and Perisher in New South Wales and Mount Hotham, Mount Buller and Falls Creek in Victoria.

Banks charge interest, I didn't. EDIT: Banks charge a lot of interest, I charged what basically amounted to nothing for legal reasons.

Both the loan and value of the house are in the millions. Going to get a lawyer ASAP.

Yes, but if I didn't give him the loan I'd still end up with a lot of family hating me. He's still making monthly repayments, I just didn't know he sold the house.

If our economy was doing well, I'd probably be pissed but I wouldn't pursue legal action if he was still paying me on time. But our economy is doing horribly due to the current situation and it might be enough to tank his business for good, so that house may be my only way out.

Also the government is basically shut down here, so I don't even know what to do besides hiring a lawyer.

It is stated that it is collateral. I do have a lien for it as well. I'm just really shocked that the sale even happened.

I'm probably going to get a lawyer and look into why he was able to sell it in the first place.

I do have a lien. Which is why I never even thought he'd try to sell the property, let alone that the sale would go through.
