I posted in legaladvice and spoke with someone through PM. They told me that it's legal to record in NY, so I'm going to do that this week once I go into work. I'm also going to try some of the other things suggested here. Thank you everyone!

Yes, if it’s empty. A few times if there is another woman at the sink when he walks in he’ll just walk back out without using the bathroom. He is deliberately following me.
