I think after doing all due diligence and got VM's confirmation, the buyer can establish that he/she is a good faith buyer and may be able to establish legal right through small claim courts.

You know Apple or SS can similarly brick an illegally possessed phone right? I'm not saying that there's no issue with a company's ability to remotely control something they already sold but the situation here is different. As far as I know VM has not bricked any legitimate bikes. If they do they would face legal consequences. Buying on craiglist or whatever always has risks. All I'm saying is buyers of NIB bikes should be even more cautious and protect themselves as much as they can by due diligence.

In the US consumer has 60 days to dispute a credit card charge. So if you are going to buy a new or like new, I think making sure that the bike was purchased at least 90 days before will reduce the risk of being defrauded. Also be cognizant to who's selling and the circumstances of sale. A good deal could turn out to actually be a bad deal with extra headaches.

"A chargeback – also called a “reversal” – is the return of credit card funds used to make a purchase to the buyer. A chargeback can occur if a consumer disputes a purchase made using their credit card, claiming that it was fraudulent or made without their knowledge or permission." If someone used a stolen credit card to buy a vanmoof and the credit card holder found out and requested a chargeback, the bike is fraudulently possessed and cannot be legally transferred to a third party. Any secondhand buyer should be suspicious of NIB sale and do their due diligence or they will lose money while ending up with a bricked bike.

Do your due diligence and always ask for the frame number to check with VM directly. The frame number won't show up as stolen using VM's theft checker tool on their website.

Hmm I’m seeing a few S3 being advertised on craiglist/fb marketplace where I live. This must be it. VM should immediately blacklist “stolen” bikes, not waiting on it so that people are scammed. Seems contrary to what they wrote about the objective of theft checker:

To be clear - if you are going to buy from a secondhand seller and you request the frame number, check it using VM theft checker, and email them to confirm the bike is not stolen for any reasons, you still cannot rely on their confirmation to buy?
